【摘要】："綠色金融"又被稱(chēng)為"可持續(xù)性金融",主要是基于環(huán)�？紤],以全新視角審視金融業(yè)經(jīng)營(yíng)理念及管理機(jī)制,從而實(shí)現(xiàn)可持續(xù)發(fā)展目的。本文結(jié)合興業(yè)銀行在踐行"赤道原則"方面的經(jīng)驗(yàn)及其獲得的成果,并研究了不久前在我國(guó)舉辦的G20峰會(huì)對(duì)綠色金融法律構(gòu)建的促進(jìn)作用,以期能夠?yàn)槲覈?guó)綠色金融行業(yè)的快速發(fā)展提供參考。本文首先對(duì)綠色金融的發(fā)展脈絡(luò)進(jìn)行梳理,并對(duì)其發(fā)展的主流觀點(diǎn)進(jìn)行分析研究;其次,對(duì)國(guó)內(nèi)綠色金融行業(yè)相關(guān)機(jī)制的不完善及實(shí)踐展開(kāi)的難點(diǎn)和法律不足進(jìn)行探討,并對(duì)比研究了國(guó)際上一些發(fā)達(dá)國(guó)家的綠色金融法律實(shí)踐狀況;最后,基于構(gòu)建全面性綠色金融機(jī)制的思維角度,提出了綠色金融激勵(lì)機(jī)制的構(gòu)建、綠色金融風(fēng)險(xiǎn)防范機(jī)制的構(gòu)建、綠色金融監(jiān)管機(jī)制的構(gòu)建、金融機(jī)構(gòu)違反綠色金融法律要求的責(zé)任追究機(jī)制構(gòu)建的具體方法。
[Abstract]:"Green finance", also known as "sustainable finance", is mainly based on environmental protection considerations, and looks at the management concept and management mechanism of the financial industry from a new perspective. In order to achieve the goal of sustainable development, this paper combines the experience of SocGen Bank in implementing the Equator principle and its achievements, and studies the role of the G20 Summit held recently in China in promoting the construction of green financial law. In order to provide a reference for the rapid development of green finance industry in China. Firstly, this paper combed the development of green finance, and analyzed the mainstream views of its development; secondly, This paper probes into the imperfections of domestic green finance industry related mechanisms, the difficulties in practice and the lack of laws, and makes a comparative study on the legal practice of green finance in some developed countries in the world. Finally, it studies the legal practice of green finance in some developed countries. Based on the thinking angle of constructing a comprehensive green financial mechanism, the paper puts forward the construction of green financial incentive mechanism, the construction of green financial risk prevention mechanism, the construction of green financial supervision mechanism. Financial institutions violate the requirements of the green financial law accountability mechanism to build a specific method.
