【摘要】：管理人的選任方式和報酬制度高度影響著管理人隊伍素質(zhì)的養(yǎng)成。對于已實施了10年的現(xiàn)行的管理人選任制度和報酬制度,本文提出了以下幾點完善建議。第一,允許重整策劃中介機構(gòu)擔(dān)任管理人,并允許法院根據(jù)重整申請人的推薦指定管理人;第二,重構(gòu)管理人對有擔(dān)保財產(chǎn)的收費制度,并深化管理人報酬制度的市場化運作,包括在通過競爭方式指定管理人的模式下,引入按時計酬制度作為補充,推動實現(xiàn)管理人報酬的分期支付或預(yù)付制度等。
[Abstract]:The selection and compensation system of manager has a great influence on the quality of manager team. For the current system of manager selection and compensation, which has been implemented for 10 years, this paper puts forward the following suggestions. Allowing the reorganization planning intermediary to act as the administrator, and allowing the court to appoint the administrator according to the recommendation of the reorganization applicant; second, to restructure the administrator's charge system for the secured property, and to deepen the market-oriented operation of the manager's remuneration system. Under the mode of appointing manager through competition, the system of timely pay is introduced as a supplement, and the system of installment or prepayment of manager's remuneration is promoted.
