【摘要】：《預(yù)算法》第5條規(guī)定,國有資本經(jīng)營預(yù)算與一般公共預(yù)算、社會保險基金預(yù)算應(yīng)當(dāng)相互銜接。吊詭的是,預(yù)算法和其他財(cái)政法律未就如何銜接提供明確的規(guī)則指引。國有資本經(jīng)營預(yù)算銜接面臨法律規(guī)則缺位的窘境,不但使政府財(cái)政行為無所適從,還會影響有限財(cái)政資源的配置效率。此問題的解決之道暗含國有資本經(jīng)營預(yù)算功能定位的本源性命題,學(xué)界對此頗有分歧,形成了"營利性"與"公共性"兩大進(jìn)路。事實(shí)上,在"中國語境"下,上述進(jìn)路仍有商榷的空間。從歷史發(fā)展脈絡(luò)看,國有資本經(jīng)營預(yù)算應(yīng)當(dāng)具備資本性和社會性功能,以此為根基科學(xué)合理地設(shè)計(jì)國有資本經(jīng)營預(yù)算與其他預(yù)算在資金流動、科目設(shè)置、流轉(zhuǎn)比例等法律規(guī)則。
[Abstract]:Article 5 of the Budget Law stipulates that the budget for the operation of state capital and the general public budget and the budget for social insurance funds shall be linked to each other. The Budget Law and other financial laws do not provide clear guidance on how to link up. It also affects the efficiency of limited financial resources allocation. The solution to this problem implies the original proposition of the function orientation of state-owned capital management budget, which has been divided in academic circles, and has formed two major paths of "profit" and "publicity". In fact, there are two main ways to solve the problem: "profit" and "publicity". Under the "Chinese context", there is still room for discussion on the above route. From the historical development context, the state-owned capital management budget should have capital and social functions. On the basis of this, the author scientifically and reasonably designs the legal rules such as capital flow, subject setting and circulation proportion between the state-owned capital management budget and other budgets.
