【摘要】：校園網(wǎng)絡(luò)借貸是一種以互聯(lián)網(wǎng)技術(shù)發(fā)展為基礎(chǔ)結(jié)合民間借貸所形成的借貸方式,這一新型借貸模式對我國現(xiàn)有的法律規(guī)范提出了挑戰(zhàn)。許多校園隨處可見“借貸寶、校貸”的廣告,數(shù)以千計的學(xué)生卷入了一場場校園網(wǎng)絡(luò)借貸事件,甚至發(fā)生最近的“校園裸貸事件”。目前,我國的校園網(wǎng)絡(luò)借貸處于一種“弱監(jiān)管、弱規(guī)制”的狀態(tài),問題層出不窮,只有盡早制定完善的網(wǎng)絡(luò)借貸法律制度才能擺脫這一局面。本文的重點放在第二部分和第三部分,筆者希望通過分析校園網(wǎng)絡(luò)借貸中的法律關(guān)系,歸納破壞原法律關(guān)系的行為,探究產(chǎn)生這些違法和犯罪行為的原因,從而找出網(wǎng)絡(luò)借貸法律規(guī)制中還存在的缺陷,為最終完善校園網(wǎng)絡(luò)借貸法律規(guī)制做好鋪墊。本文主要按照以下思路進行探索:首先,簡要闡述校園網(wǎng)絡(luò)借貸的內(nèi)涵以及裸貸事件;其次,理順了校園網(wǎng)絡(luò)借貸的民事法律關(guān)系,奠定法律理論基礎(chǔ);再次,總結(jié)了容易出現(xiàn)在網(wǎng)絡(luò)借貸過程中的民事違法行為和刑事犯罪行為,突出問題之所在;而后,分析出產(chǎn)生違法行為和犯罪行為的根源是法律規(guī)制的缺失,歸納校園網(wǎng)絡(luò)借貸中有哪些法律規(guī)制上的缺陷存在;最后,提出完善建議。
[Abstract]:Campus network lending is a kind of borrowing method based on the development of Internet technology and folk lending. This new lending mode has challenged the existing laws and regulations of our country. Many campuses can see "borrowing treasure" everywhere. Thousands of students have been involved in a series of campus online lending incidents, and even the recent "campus loan incidents" have taken place. At present, our country's campus network lending is in a state of "weak supervision and weak regulation." Problems emerge in endlessly, only by establishing a perfect legal system of network lending as soon as possible can we get rid of this situation. The focus of this paper is on the second and third parts. The author hopes to analyze the legal relationship in campus network lending. Induces the behavior which destroys the original legal relationship, probes into the causes of these illegal and criminal acts, and finds out the defects in the legal regulation of network lending. In order to finally perfect the legal regulation of campus network lending. This paper mainly according to the following ideas to explore: first, a brief description of the connotation of campus network lending and bare loan events; secondly, Straighten out the civil legal relationship of campus network lending, lay the legal theoretical foundation; thirdly, summarize the civil illegal and criminal acts that are easy to appear in the course of network lending, and highlight the problem. Analysis of the root causes of illegal behavior and criminal behavior is the lack of legal regulation, sum up the campus network lending in which there are some defects in the legal regulation; finally, put forward some suggestions for improvement.
