【摘要】:20世紀(jì)末PPP(Public-Private Partnership)模式,即公私合作伙伴關(guān)系在全球范圍內(nèi)興起。與政府單獨(dú)實(shí)施的項(xiàng)目模式相比,PPP模式能夠更好的解決政府財(cái)政不足、效率低下的問題。進(jìn)入21世紀(jì)后,中國面臨著經(jīng)濟(jì)、人口增長所帶來的基礎(chǔ)設(shè)施建設(shè)方面的巨大壓力。PPP模式成為解決這一難題的可行方案,并在中國興起。但PPP項(xiàng)目在實(shí)際運(yùn)行中存在著違約、違規(guī)問題,不能發(fā)揮其應(yīng)有作用。因此,對PPP項(xiàng)目進(jìn)行監(jiān)管十分必要。分析PPP項(xiàng)目監(jiān)管方法及我國PPP項(xiàng)目監(jiān)管現(xiàn)狀,發(fā)現(xiàn)存在的不足并尋求完善途徑,成為推進(jìn)我國PPP模式發(fā)展的重要任務(wù)。本文主要包括以下幾部分內(nèi)容:第一部分,PPP基本概念與監(jiān)管理論。本部分主要對PPP的概念、流程、PPP項(xiàng)目中政府的身份以及監(jiān)管理論進(jìn)行介紹。通過了解PPP和監(jiān)管相關(guān)理論,建立對PPP項(xiàng)目監(jiān)管的基本認(rèn)識。第二部分,PPP項(xiàng)目監(jiān)管分析。在具體PPP項(xiàng)目中,可通過協(xié)議、項(xiàng)目公司治理以及行政手段對項(xiàng)目進(jìn)行監(jiān)管。三類監(jiān)管的監(jiān)管主體、監(jiān)管權(quán)來源、監(jiān)管內(nèi)容、監(jiān)管權(quán)性質(zhì)以及監(jiān)管權(quán)的行使方式各不相同。分析三類監(jiān)管,發(fā)現(xiàn)其優(yōu)點(diǎn)及存在的不足,對完善PPP項(xiàng)目監(jiān)管具有重要意義。第三部分,我國PPP模式法律規(guī)范分析。梳理立法沿革,了解我國PPP模式法律規(guī)范的發(fā)展歷史和階段性特征,加深對PPP模式法律規(guī)范的了解。對PPP領(lǐng)域主要適用的法律規(guī)范按照制定主體和適用范圍進(jìn)行整理,了解現(xiàn)行規(guī)范體系。分析當(dāng)前我國法律規(guī)范對PPP項(xiàng)目的具體監(jiān)管規(guī)定,了解監(jiān)管內(nèi)容。第四部分,我國PPP項(xiàng)目監(jiān)管存在的不足及完善建議。作者認(rèn)為當(dāng)前我國PPP項(xiàng)目監(jiān)管存在PPP模式法律法規(guī)供給不足、監(jiān)管機(jī)構(gòu)缺乏獨(dú)立性、協(xié)議監(jiān)管不完善、項(xiàng)目公司內(nèi)部監(jiān)管重視不夠、社會監(jiān)督途徑有限等不足,限制了監(jiān)管作用的發(fā)揮。應(yīng)該通過制定完善的法律法規(guī)、建立獨(dú)立的監(jiān)督機(jī)構(gòu)、加強(qiáng)協(xié)議監(jiān)管、強(qiáng)化項(xiàng)目公司內(nèi)部監(jiān)管、拓寬社會監(jiān)督途徑的方式予以完善。
[Abstract]:At the end of 20th century, the PPP(Public-Private partnership model, the public-private partnership (PPPs), emerged worldwide. Compared with the project model implemented by the government alone, the PPP(Public-Private model can better solve the problem of insufficient government finances and low efficiency. China is facing enormous economic, population growth, infrastructure construction pressure. The PPP model has become a feasible solution to this problem, and has emerged in China. But in practice, the PPP project has defaulted and violated the rules. Therefore, it is very necessary to supervise the PPP project. This paper analyzes the methods of PPP project supervision and the present situation of PPP project supervision in China, finds out the deficiency and seeks the perfect way. It is an important task to promote the development of PPP mode in China. This paper mainly includes the following parts: the first part is the basic concept and supervision theory of PPP. This paper introduces the identity of the government and the theory of supervision in the PPP project. Through the understanding of the theory of PPP and supervision, the basic understanding of the supervision of the PPP project is established. The second part is the analysis of the supervision of the PPP project. In the specific PPP project, the agreement can be adopted. Project corporate governance and administrative means to supervise the project. Three types of supervision of the main body, regulatory authority sources, regulatory content, the nature of regulatory rights and the exercise of regulatory rights are different. Analysis of the three types of supervision, It is of great significance to perfect the supervision of PPP project. The third part, the analysis of the legal norms of PPP model in China, combs the history of legislation, and understands the history and stage characteristics of the legal norms of PPP model in China. To deepen the understanding of the legal norms of the PPP model. The main applicable legal norms in the field of PPP are sorted out according to the subject and scope of application, and the current normative system is understood. The specific supervision and regulations of the current legal norms on the PPP projects in China are analyzed. The author thinks that the current PPP project supervision in our country has insufficient supply of laws and regulations of PPP mode, lack of independence of supervision organization, imperfect supervision of agreement, and so on, in the part of 4th, the author thinks that there is insufficient supply of laws and regulations for PPP project supervision in our country. Insufficient attention to the internal supervision of the project company and limited channels of social supervision limit the role of supervision. We should establish an independent supervisory body and strengthen the agreement supervision by making perfect laws and regulations. Strengthen the internal supervision of the project company, broaden the way of social supervision to be improved.
