【摘要】：推進綜合執(zhí)法,是貫徹落實依法行政、深化行政執(zhí)法管理體制改革的重要環(huán)節(jié)。黨的十八屆四中全會中就提出要在食藥安全、工商質(zhì)檢、文化旅游等領(lǐng)域內(nèi)推行跨部門綜合執(zhí)法。旅游業(yè)是海南省支柱性產(chǎn)業(yè),早就已經(jīng)形成了一整套完整的產(chǎn)業(yè)鏈條。并且海南省旅游發(fā)展模式在全國范圍內(nèi)具有典型代表性,在相關(guān)法律法規(guī)、中央政策、海南省政策支持下,海南旅游行業(yè)領(lǐng)域是符合推行跨部門綜合執(zhí)法條件的。鑒于此,本文對海南構(gòu)建旅游綜合執(zhí)法機制進行了探討,共分為四個部分:第一部分是對旅游執(zhí)法背景、意義以及相關(guān)概念的介紹。由于我國旅游市場迅猛發(fā)展以及我國行政執(zhí)法管理體制改革的需要,使得旅游綜合執(zhí)法機制構(gòu)建被提上日程。特別是對于以旅游業(yè)為重要支柱產(chǎn)業(yè)的海南省而言,推行旅游綜合執(zhí)法是促進旅游業(yè)健康發(fā)展和國民經(jīng)濟持續(xù)增長的重要保障。行政執(zhí)法包含單一執(zhí)法、聯(lián)合執(zhí)法和綜合執(zhí)法三種模式,三者有著各自的特點。第二部分是對海南旅游執(zhí)法機制現(xiàn)狀進行調(diào)查介紹與評析。海南省旅游發(fā)展委員會是海南現(xiàn)有旅游行政管理部門,具備有關(guān)旅游執(zhí)法、監(jiān)管等方面的職能。部門橫向協(xié)作執(zhí)法監(jiān)管方面,主要是由旅游委牽頭相關(guān)執(zhí)法部門的聯(lián)合執(zhí)法方式。當前旅游業(yè)發(fā)展迅猛,旅游市場問題層出不窮,海南當前的旅游執(zhí)法機制也面臨巨大挑戰(zhàn)。第三部分主要討論海南構(gòu)建旅游綜合執(zhí)法機制的必要性與可行性。旅游業(yè)包含吃、住、行、游、購、娛六大要素,旅游市場的執(zhí)法問題也涉及多個行政部門。綜合執(zhí)法機制的建立有助于化解職責重疊、權(quán)力分散等問題,杜絕旅游執(zhí)法亂象。國家和海南省相繼出臺的法規(guī)、政策為旅游綜合執(zhí)法改革提供了重要依據(jù)。從理論上講,旅游綜合執(zhí)法有助于精簡機構(gòu)、節(jié)約成本,提高執(zhí)法效率以及保證權(quán)力與責任的統(tǒng)一。國內(nèi)其它一些地區(qū)在旅游綜合執(zhí)法方面的嘗試為海南省提供了寶貴的實踐經(jīng)驗,并且海南在三亞和萬寧探索的"1+3"執(zhí)法創(chuàng)新機制探索為海南旅游綜合執(zhí)法機制創(chuàng)設(shè)提供了實踐基礎(chǔ)。第四部分是對構(gòu)建海南旅游綜合執(zhí)法機制的相關(guān)建議。具體實施過程中,海南省應(yīng)通過地方立法、特區(qū)立法等方式明確旅游綜合執(zhí)法權(quán)依據(jù)、明確旅游綜合執(zhí)法機制基本原則來完善旅游綜合執(zhí)法法律體系建設(shè),同時對旅游綜合執(zhí)法機構(gòu)設(shè)置、旅游綜合執(zhí)法隊伍建設(shè)和對綜合執(zhí)法的監(jiān)督機制的完善。
[Abstract]:Promoting comprehensive law enforcement is an important link in implementing the reform of the administrative system of administration by law and deepening the reform of the administrative law enforcement system. In the fourth Plenary session of the 18 Central Committee of the CPC Central Committee, it was proposed that food and medicine safety, quality inspection for industry and commerce should be carried out. The tourism industry is a pillar industry in Hainan Province, and has already formed a whole set of complete industrial chains. Moreover, the tourism development model of Hainan Province is typical across the country. With the support of relevant laws and regulations, central policies and policies of Hainan Province, the tourism industry in Hainan conforms to the conditions of carrying out comprehensive law enforcement across departments. In view of this, this paper discusses the construction of comprehensive law enforcement mechanism for tourism in Hainan. It is divided into four parts: the first part introduces the background, significance and related concepts of tourism law enforcement. The construction of a comprehensive tourism law enforcement mechanism has been put on the agenda. Especially for Hainan Province, where tourism is an important pillar industry, The promotion of comprehensive law enforcement of tourism is an important guarantee to promote the healthy development of tourism and the sustained growth of the national economy. Administrative law enforcement includes three modes: single law enforcement, joint law enforcement and comprehensive law enforcement. The three have their own characteristics. The second part is to investigate, introduce and evaluate the present situation of Hainan tourism law enforcement mechanism. Hainan Provincial Tourism Development Commission is the existing tourism administrative department in Hainan, which has the relevant tourism law enforcement. The functions of supervision and other aspects. In the aspect of horizontal coordination of law enforcement and supervision by departments, it is mainly the joint law enforcement method of the relevant law enforcement departments led by the Tourism Commission. At present, the tourism industry is developing rapidly, and the tourism market problems are emerging in endlessly. Hainan's current tourism law enforcement mechanism also faces enormous challenges. The third part mainly discusses the necessity and feasibility of building Hainan's comprehensive tourism law enforcement mechanism. Tourism includes six major elements: eating, living, traveling, traveling, buying and entertaining. The problem of enforcing the law in the tourism market also involves many administrative departments. The establishment of a comprehensive law enforcement mechanism will help to resolve the problems of overlapping responsibilities, decentralization of power, and put an end to the confusion of tourism law enforcement. The state and Hainan Province have successively promulgated laws and regulations. The policy provides an important basis for the reform of comprehensive tourism law enforcement. In theory, comprehensive tourism law enforcement helps streamline institutions and save costs. To improve the efficiency of law enforcement and to ensure the unity of power and responsibility. The attempts of some other areas in the country in the area of comprehensive law enforcement of tourism have provided Hainan Province with valuable practical experience. And the "13" law enforcement innovation mechanism explored by Hainan in Sanya and Wanning provides a practical basis for the establishment of Hainan tourism comprehensive law enforcement mechanism. Part 4th is the relevant suggestions for the construction of Hainan comprehensive tourism law enforcement mechanism. Hainan Province should make clear the basis of comprehensive tourism law enforcement right by means of local legislation and special zone legislation, make clear the basic principles of comprehensive tourism law enforcement mechanism to perfect the construction of comprehensive tourism law enforcement legal system, and set up comprehensive tourism law enforcement agencies at the same time. The construction of tourism comprehensive law enforcement team and the perfection of supervision mechanism for comprehensive law enforcement.
