WTO體系下我國影視行業(yè)政策法規(guī)改革研究

【摘要】:我國加入WTO之后,影視行業(yè)的發(fā)展與國際社會的關(guān)系越來越密切,充分研究WTO中有關(guān)文化產(chǎn)業(yè)的規(guī)定,特別是有關(guān)貿(mào)易政策與產(chǎn)業(yè)政策的沖突與協(xié)調(diào)部分的內(nèi)容對于解決該類問題至關(guān)重要。同時對英國、美國、法國、韓國、印度等代表性國家的影視行業(yè)政策法規(guī)進行剖析比較,了解不同國家的不同的影視政策以及其中的成效與不足,并以此為基礎(chǔ)分析我國的影視行業(yè)政策,最終在WTO框架下完善我國影視行業(yè)改革與發(fā)展的法律規(guī)定,最大限度地促進我國影視行業(yè)的長足發(fā)展。本文除引言和結(jié)論外,由四部分組成。第一部分:WTO規(guī)定與影視行業(yè)政策法規(guī)之關(guān)系。這一部分主要分為兩節(jié):第一節(jié)是與影視行業(yè)有關(guān)的WTO規(guī)定,包括影視行業(yè)的基本介紹以及相關(guān)的WTO原則與規(guī)則。第二節(jié)是WTO規(guī)定與影視行業(yè)政策法規(guī)之互動關(guān)聯(lián)性,首先闡釋了一般意義上貿(mào)易政策與產(chǎn)業(yè)政策的沖突與協(xié)調(diào),在此基礎(chǔ)上指出影視行業(yè)政策法規(guī)要符合WTO規(guī)則。第二部分:WTO體系下國外五國影視行業(yè)政策法規(guī)研究。本部分共分為三節(jié),前兩節(jié)對美國、法國、英國、韓國以及印度五國的國內(nèi)與WTO相關(guān)的影視行業(yè)產(chǎn)業(yè)政策法規(guī)以及貿(mào)易政策法規(guī)進行梳理,發(fā)現(xiàn)不同國家的特點。第三節(jié)是分析這些國家產(chǎn)業(yè)政策法規(guī)與貿(mào)易政策法規(guī)之間的協(xié)調(diào)策略,希望可以找出為我國借鑒的地方。第三部分:WTO體系下我國影視行業(yè)政策法規(guī)之現(xiàn)狀分析。該部分分為兩節(jié):第一節(jié)是我國影視行業(yè)政策法規(guī)概述,通過從產(chǎn)業(yè)政策法規(guī)和貿(mào)易政策法規(guī)兩方面對目前我國在調(diào)整影視行業(yè)領(lǐng)域具有重要作用法規(guī)的分析,也對我國入世前后影視行業(yè)政策法規(guī)進行比較,進而在第二節(jié)中歸納出我國影視行業(yè)政策法規(guī)存在的問題,具體包括影視行業(yè)政策扶持力度尚待提升,進出口政策不合理,配額制度的廣泛存在,國內(nèi)立法體系不健全等四個方面的問題。第四部分:WTO體系下我國影視行業(yè)政策法規(guī)之完善建議。這一部分分為三節(jié):第一節(jié)是我國目前影視行業(yè)所處的國際境況,從我國影視行業(yè)目前所面臨的機遇和挑戰(zhàn)兩方面入手分析。第二節(jié)是我國影視行業(yè)產(chǎn)業(yè)政策法規(guī)的完善建議,主要是需要加強政策扶持力度與完善國內(nèi)相關(guān)立法。前者表現(xiàn)為從增加投資稅收優(yōu)惠、產(chǎn)權(quán)保護創(chuàng)意產(chǎn)業(yè)等方面對影視行業(yè)進行扶持;后者則表現(xiàn)為通過頒布影視行業(yè)促進法、合并電影與電視劇法規(guī)的辦法整合國內(nèi)影視行業(yè)立法,促進我國影視行業(yè)的良性發(fā)展。第三節(jié)是我國影視行業(yè)貿(mào)易政策法規(guī)的完善建議,即在進口方面放開影視行業(yè)進口權(quán),在出口方面進一步刺激出口,加大出口政府補貼,逐漸取消配額制度,可以通過以進口數(shù)量配額換扶持以及以播放時間配額換扶持兩種方法逐漸取消配額制度。
[Abstract]:After China's entry into the WTO, the development of the film and television industry is more and more closely related to the international community. In particular, the content of the conflict and coordination part of trade policy and industrial policy is very important to solve this kind of problem. At the same time, it analyzes and compares the policies and regulations of the film and television industry in Britain, the United States, France, South Korea, India and other representative countries. Understand the different film and television policies of different countries and their effects and shortcomings, and analyze the film and television industry policies of our country on the basis of this, and finally perfect the legal provisions for the reform and development of China's film and television industry under the framework of WTO. In addition to the introduction and conclusion, this paper will promote the rapid development of China's film and television industry to the maximum extent. It consists of four parts. The first part is about the relationship between the WTO regulations and the policies and regulations of the film and television industry. This part is mainly divided into two sections: the first section is the WTO regulations related to the film and television industry. The second section is the interactive relationship between the WTO regulations and the policies and regulations of the film and television industry. First, it explains the conflict and coordination between the trade policy and the industrial policy in general sense. On this basis, it is pointed out that the policies and regulations of the film and television industry should conform to the WTO rules. The second part is a study of the policies and regulations of the film and television industry in five foreign countries under the system of WTO. This part is divided into three sections, the first two sections of which are about the United States, France, Britain, The domestic policies and regulations of the film and television industry and the trade policies and regulations related to WTO in South Korea and India are combed out. Find out the characteristics of different countries. The third section is to analyze the coordination strategies between industrial policies and trade policies and regulations of these countries. The third part is the analysis of the current situation of China's film and television industry policies and regulations under the WTO system. This part is divided into two sections: the first section is an overview of China's film and television industry policies and regulations. Based on the analysis of the important role of China in adjusting the field of film and television industry from the two aspects of industrial policy and trade policy and regulation, this paper also compares the policies and regulations of film and television industry before and after China's entry into WTO. Then in the second section, we conclude the problems existing in the policies and regulations of China's film and television industry, including the need to enhance the policy support of the film and television industry, the unreasonable import and export policy, the widespread existence of the quota system, This part is divided into three sections: the first section is the international situation of the film and television industry in China, the first section is the international situation of the film and television industry in China. This paper analyzes the opportunities and challenges faced by the film and television industry in China. The second section is the suggestions for the improvement of the policies and regulations of the film and television industry in China. It mainly needs to strengthen the policy support and perfect the relevant domestic legislation. The former is to support the film and television industry from the aspects of increasing the tax preference for investment, protecting the creative industry of property right and so on; the latter is the promotion law of the film and television industry through the promulgation of the law on the promotion of the film and television industry. The method of merging the laws and regulations of film and TV series integrates the legislation of domestic film and television industry to promote the sound development of the film and television industry in China. Section three is the perfect suggestion of the trade policies and regulations of China's film and television industry, that is, to liberalize the import right of the film and television industry in terms of import. In the aspect of export, we can further stimulate the export, increase the government subsidy of export, gradually abolish the quota system, we can gradually cancel the quota system by means of the quota of import quantity for support and the quota of playing time for support.
