【摘要】：地震災(zāi)害是近年來我國遭受損失最嚴(yán)重的災(zāi)害類型,具有發(fā)生不確定性和損失嚴(yán)重性的特點。防范地震災(zāi)害的有效手段是通過地震保險對災(zāi)害進行防治、對損失進行分擔(dān),而利用法律對地震保險提供支持和進行規(guī)制是當(dāng)今地震保險研究的重要課題。目前,地震保險立法模式主要有3種,即地震保險計劃、地震保險專門法和統(tǒng)一巨災(zāi)保險法,文章對3種模式的優(yōu)缺點進行了客觀細致地分析,并深刻檢討我國當(dāng)前的立法狀況,提出未來地震保險法應(yīng)選擇的立法模式,進而提出明確的完善路徑。
[Abstract]:Earthquake disaster is the most serious disaster type in China in recent years, which has the characteristics of uncertainty and severity of loss. The effective way to prevent earthquake disaster is to prevent and control the disaster by means of earthquake insurance and share the loss. The use of laws to support and regulate earthquake insurance is an important topic in the study of earthquake insurance. At present, there are three main legislative models of earthquake insurance, namely, earthquake insurance plan, special law of earthquake insurance and unified catastrophe insurance law. In this paper, the advantages and disadvantages of the three models are analyzed objectively and carefully, and the current legislative situation of our country is deeply reviewed, and the legislative model that should be chosen in the future earthquake insurance law is put forward, and then the clear perfect path is put forward.
