【摘要】:在現(xiàn)有的市場(chǎng)經(jīng)濟(jì)條件下,消費(fèi)行為的發(fā)生是經(jīng)濟(jì)發(fā)展的前提及基礎(chǔ),而消費(fèi)行為開始的前提是消費(fèi)者能夠?qū)οM(fèi)的客體有一定的認(rèn)知,這就取決于消費(fèi)者所能夠獲得的消費(fèi)信息的數(shù)量及質(zhì)量。但是,現(xiàn)實(shí)生活中由于消費(fèi)信息不對(duì)稱問題的存在,消費(fèi)者的合法權(quán)益屢屢受到侵害,經(jīng)營(yíng)者也常常利用消費(fèi)者的信息弱勢(shì)地位獲取非法利益。消費(fèi)者能夠掌握充分、有效的信息對(duì)消費(fèi)者權(quán)益的保護(hù)具有基礎(chǔ)性的作用,所以研究消費(fèi)信息不對(duì)稱及其帶來負(fù)面影響,并分析其產(chǎn)生的原因,以期找到確實(shí)可行的解決路徑,為消費(fèi)者權(quán)益的保護(hù)提供理論上的支持就具有很重要的現(xiàn)實(shí)意義。 文章主要通過五個(gè)部分的內(nèi)容對(duì)消費(fèi)信息不對(duì)稱進(jìn)行研究分析:首先,以“消費(fèi)信息不對(duì)稱法律規(guī)制”為核心詞,對(duì)消費(fèi)信息不對(duì)稱法律規(guī)制的相關(guān)概念加以界定,通過厘清消費(fèi)信息不對(duì)稱的法學(xué)原理及經(jīng)濟(jì)學(xué)原理,重點(diǎn)說明消費(fèi)信息不對(duì)稱法律規(guī)制的法理解析,明確消費(fèi)信息不對(duì)稱法律規(guī)制的變遷、定位及其特征;其次,對(duì)消費(fèi)信息不對(duì)稱及其法律規(guī)制做實(shí)然性分析,即在探討我國(guó)消費(fèi)信息不對(duì)稱法律規(guī)制現(xiàn)狀的基礎(chǔ)上,綜合分析消費(fèi)信息不對(duì)稱存在的問題、這些問題產(chǎn)生的原因以及消費(fèi)信息不對(duì)稱帶來的危害;再次,通過分析歐美日等國(guó)家關(guān)于消費(fèi)信息不對(duì)稱的法律規(guī)制辦法,結(jié)合我國(guó)的實(shí)踐,找到對(duì)我國(guó)消費(fèi)信息不對(duì)稱法律規(guī)制有借鑒意義的法律規(guī)制方式;其四,在對(duì)消費(fèi)信息不對(duì)稱法律規(guī)制工具進(jìn)行一般分析的基礎(chǔ)上,分析一些可供選擇的核心規(guī)制工具的運(yùn)用及其他規(guī)制工具的特性;最后,結(jié)合前面所做的分析,以及我國(guó)現(xiàn)行法律體系中關(guān)于消費(fèi)信息不對(duì)稱規(guī)制的立法及執(zhí)法情況,提出一系列具體的完善建議,以期為解決我國(guó)消費(fèi)信息不對(duì)稱問題提供一些理論幫助。
[Abstract]:In the current market economy, the occurrence of consumer behavior is the premise and foundation of economic development, and the premise of consumer behavior is that consumers can have a certain understanding of the object of consumption. This depends on the quantity and quality of consumer information that consumers can obtain. However, due to the existence of asymmetric consumer information in real life, the legitimate rights and interests of consumers are often infringed upon. Operators also often take advantage of consumers' weak position of information to obtain illegal interests. Consumers can master sufficient and effective information and play a fundamental role in protecting consumers' rights and interests. Therefore, it is of great practical significance to study the asymmetry of consumer information and its negative effects, and to analyze the causes of its emergence, in order to find a feasible solution and provide theoretical support for the protection of consumers' rights and interests. This paper mainly analyzes the asymmetry of consumer information through five parts: firstly, taking the "legal regulation of asymmetric consumer information" as the core word, it defines the related concepts of the legal regulation of asymmetric consumer information. By clarifying the legal and economic principles of asymmetric consumer information, this paper focuses on the legal analysis of the asymmetric legal regulation of consumer information, and clarifies the changes, positioning and characteristics of the legal regulation of asymmetric consumer information; secondly, On the basis of discussing the current situation of the legal regulation of the asymmetry of consumer information in our country, the paper comprehensively analyzes the problems existing in the asymmetry of consumer information, and makes a practical analysis of the asymmetry of consumption information and its legal regulation. The causes of these problems and the harm caused by the asymmetry of consumer information. Thirdly, through the analysis of the legal regulations on asymmetric consumer information in Europe, America, Japan and other countries, combined with the practice of our country, To find the legal regulation of asymmetric consumer information in China has reference significance of legal regulation; fourth, on the basis of the general analysis of the legal regulation tools of asymmetric consumer information, This paper analyzes the application of some core regulatory tools and the characteristics of other regulatory tools. Finally, combining with the previous analysis, and the legislation and enforcement of the asymmetric regulation of consumer information in the current legal system of our country, A series of concrete suggestions are put forward in order to provide some theoretical help to solve the problem of asymmetric consumption information in China.
