【摘要】：農(nóng)村城市化歷史遺留違法建筑是深圳城市化進程中特有現(xiàn)象,也是我國城鄉(xiāng)二元經(jīng)濟社會結(jié)構(gòu)的產(chǎn)物。由于土地產(chǎn)權的二元屬性,造成了城市化歷史遺留違法建筑的大量衍生,與合法入市的土地和房地產(chǎn)相互并存,形成了中國獨具特點的“城中村”現(xiàn)象。2013年12月30日,深圳市人民政府出臺了《〈深圳市人民代表大會常務委員會關于農(nóng)村城市化歷史遺留違法建筑的處理決定〉試點實施辦法》(深圳市人民政府第261號令),新規(guī)于2014年4月1日起實施。深圳市開始對歷史遺留違法建筑的處理進行試點工作,進入試點的歷史遺留違法建筑就有可能得到“確認”,轉(zhuǎn)為合法建筑,納入規(guī)范管理。政策施行至今,根據(jù)全市各行政區(qū)試點改革工作成果匯總,歷史遺留違法建筑在處理確認、拆除、沒收、臨時使用等方面尚未有成功案例,主要存在政策程序制約、政策標準爭議等問題。筆者在深圳市規(guī)劃土地監(jiān)察局工作,主要工作職責是查處全市的新增違法建筑及推進歷史遺留違法建筑處理試點工作,作為處理歷史遺留違法建筑的一線工作人員,可以結(jié)合實際工作,在歷史遺留違法建筑處理問題研究方面提供新的視角。本文將在借鑒前人的研究成果的基礎上,結(jié)合自己身工作實際和相關文獻,對歷史遺留違法建筑相關概念的界定、成因的分析、相關政策的解讀、對市場經(jīng)濟、社會生活的正面、負面影響分析等方面進行研究,找出歷史遺留違法建筑處理的困境,從完善歷史遺留違法建筑現(xiàn)行政策、探索城市更新改造和納入保障性住房管理體系提出建議。
[Abstract]:The illegal building left over from the history of urbanization in rural areas is a unique phenomenon in the process of urbanization in Shenzhen. It is also the product of the dual economic and social structure of urban and rural areas in China. Due to the dual property of land property rights, a large number of illegal buildings left over from the history of urbanization are derived. Coexisting with the land and real estate that enter the market legally, the phenomenon of "village in the city", which has unique characteristics in China, was formed. In December 30th 2013, The Shenzhen Municipal people's Government issued the "decision of the standing Committee of the Shenzhen Municipal people's Congress on the handling of illegal buildings left over from the History of Rural urbanization" (decree No. 261 of the Shenzhen Municipal people's Government, New regulations on 2014). In April 1st, Shenzhen began to carry out pilot work on the disposal of illegal buildings left over from history, It is possible to "confirm" the illegal buildings left over from history into the pilot projects, convert them into legal buildings and incorporate them into standardized management. Since the implementation of the policy, according to the results of the pilot reform work in all administrative districts of the city, the illegal buildings left over from history are being processed and confirmed. Demolition, confiscation, temporary use, etc. There have not been successful cases, there are mainly problems such as policy and procedure constraints, policy standard disputes, etc. The author works in Shenzhen Planning Land Supervision Bureau. The main work responsibility is to investigate and deal with the new illegal buildings in the city and to promote the pilot work of handling the illegal buildings left over from history. As the front-line workers dealing with the illegal buildings left over from history, they may combine the actual work, This paper will draw lessons from the previous research results, and combine with the actual work and relevant literature to define the related concepts of the historical legacies of illegal buildings. Analysis of causes, interpretation of relevant policies, study of market economy, positive and negative impact analysis of social life, etc., to find out the predicament of handling illegal buildings left by history, and to improve the current policies on illegal buildings left over from history. This paper explores urban renewal and transformation and puts forward suggestions for integrating the management system of supportable housing.
