【摘要】：典當(dāng)類經(jīng)營機構(gòu)業(yè)的發(fā)展史作為我國經(jīng)濟進步過程的一個側(cè)寫,在一定程度上反映了我國經(jīng)濟的發(fā)展脈絡(luò)。從最早廣東地區(qū)開始波及至全國各個城市,典當(dāng)類經(jīng)營機構(gòu)可以說為民間百姓的生計提供了幫助。在新中國成立之初,將典當(dāng)類經(jīng)營機構(gòu)當(dāng)做了舊社會的毒瘤而加以嚴格的限制,直至改革開放市場經(jīng)濟得到了全面認可,隨著經(jīng)濟發(fā)展步伐的加快,民眾的看法和觀念出現(xiàn)了變化,市場化的改革需要在傳統(tǒng)金融體系之外,為人們?nèi)罕姷淖灾鲃?chuàng)業(yè)提供更為豐富的資金來源。在這種情況下,我國的典當(dāng)類經(jīng)營機構(gòu)重新得到了國家和人民的認可�，F(xiàn)階段,我國的典當(dāng)類經(jīng)營機構(gòu)業(yè)仍舊存在著很多的不合理,以及舊社會所遺留下來的不良風(fēng)氣,存在著過分追求自身利益、包庇接納贓款、等破壞經(jīng)濟有序健康發(fā)展的行為。這不是因為典當(dāng)類經(jīng)營機構(gòu)業(yè)存在自身不可克服的弊端和劣勢,更多地是由于國家在對于典當(dāng)類經(jīng)營機構(gòu)業(yè)運營的監(jiān)督管理機制以及手段方面存在著不足和缺陷。我國現(xiàn)行典當(dāng)類經(jīng)營項目所涉及的法律、法規(guī),大多是根據(jù)已經(jīng)發(fā)生的和已然暴露出來的問題加以剖析和處理,內(nèi)容相對滯后,對于高速發(fā)展的經(jīng)濟現(xiàn)狀很難做出強有力的支持和指導(dǎo)。同時,典當(dāng)類經(jīng)營機構(gòu)業(yè)目前涉及到的法律、法規(guī),其法律效力較之其他商法或民法條例的認可度及執(zhí)行力有著一定的差距,在面臨與其他法條相沖突的案件時,往往不能夠作為最有力的武器,對典當(dāng)雙方加以裁定,這就導(dǎo)致了在進行典當(dāng)過程時,典當(dāng)雙方很容易對現(xiàn)行的相關(guān)規(guī)定產(chǎn)生輕視乃至漠視的態(tài)度和行為。本文在梳理典當(dāng)類經(jīng)營機構(gòu)業(yè)相關(guān)法律規(guī)定的前提下,引用現(xiàn)實案例,針對性地對典當(dāng)類經(jīng)營機構(gòu)業(yè)的現(xiàn)狀提出其中的不足之處,并且,根據(jù)自身經(jīng)驗給出相對合理的建議和解決方案,以期對我國典當(dāng)類經(jīng)營機構(gòu)業(yè)相關(guān)法律、法規(guī)的制定與完善有所裨益。
[Abstract]:The history of pawn business as a profile of the process of economic progress in China, to a certain extent, reflects the development of China's economy. From the earliest Guangdong region began to spread to the various cities of the country. At the beginning of the founding of New China, the pawnbroker was regarded as the cancer of the old society and strictly restricted. Until the reform and opening up of the market economy has been fully recognized, with the pace of economic development, people's views and ideas have changed, market-oriented reform needs to be outside the traditional financial system. In this case, the pawnbroker of our country has been recognized by the state and the people again. China's pawnbroker industry still exists a lot of unreasonable, as well as the bad atmosphere left over from the old society, there is excessive pursuit of their own interests, cover up and accept the stolen money. This is not because the pawnbroker industry has its own insuperable disadvantages and disadvantages. More is due to the national supervision and management mechanism for the operation of pawnbrokers industry and the means of deficiencies. China's current pawn business projects involved in the laws and regulations. Most of them are based on the existing and exposed problems to be analyzed and dealt with, the content is relatively lagging behind, it is difficult to make strong support and guidance for the rapid development of the economic situation. At the same time. At present, the law, regulation and law effect of pawn business are different from those of other commercial law or civil law, when facing the case of conflict with other laws and regulations. It is often not possible to rule on the pawnbrokers as the most powerful weapon, which leads to the conduct of the pawning process. It is easy for pawn parties to despise and even ignore the existing relevant regulations. This paper reviews the relevant laws and regulations of pawnbroking business and cites practical cases. Put forward the shortcomings of the pawnbroker industry, and according to their own experience to give a relatively reasonable proposal and solutions, with a view to China's pawn industry related laws. The establishment and perfection of laws and regulations are beneficial.
