【摘要】：網(wǎng)絡(luò)跨境代購已經(jīng)成為了如今消費者新興的購物方式。然而,跨境代購在消費者權(quán)益保護方面卻頻頻遇到難題,如消費者知情權(quán)、公平交易權(quán)等等,其中以退貨難為主要問題。本文以網(wǎng)絡(luò)跨境代購這一消費模式和無條件撤銷權(quán)這一權(quán)利為引,通過對無條件撤銷權(quán)在跨境代購中的適用性、適用范圍以及適用條件的分析,論述了新《消費者權(quán)益保護法》中無條件撤銷權(quán)在跨境代購中適用的局限性和可能性,并提出了一些對于適用范圍和適用條件的補充建議。本文除“前言”和“結(jié)語”外,由以下四個部分構(gòu)成:第一章“網(wǎng)絡(luò)跨境代購的概述”,分析了網(wǎng)絡(luò)跨境代購的特征,論述了網(wǎng)絡(luò)跨境代購的三種形式,即私人代購、專業(yè)平臺代購以及通過轉(zhuǎn)運公司跨境網(wǎng)購。第二章“跨境代購中無條件撤銷權(quán)的適用性”,從無條件撤銷權(quán)的概念和性質(zhì)入手,探討學(xué)界對于在跨境代購中適用無條件撤銷權(quán)的不同看法,并得出結(jié)論跨境代購對于無條件撤銷權(quán)的適用具有合理性。第三章“跨境代購中無條件撤銷權(quán)的適用范圍”,分析了跨境代購的合同類型,認(rèn)定代購交易是服務(wù)交易,建議將現(xiàn)行的無條件撤銷權(quán)的適用范圍擴大到服務(wù),并且根據(jù)代購服務(wù)中的商品性質(zhì)制定適用無條件撤銷權(quán)的例外條款。第四章“跨境代購中無條件撤銷權(quán)的適用條件”,分析了跨境代購中無條件撤銷權(quán)的主體和行使條件,理清了跨境代購中三方當(dāng)事人在合同中的法律地位,并提出了對于無條件撤銷權(quán)行使期限確立方法的建議。
[Abstract]:Online cross-border purchasing has become a new way of shopping for consumers. However, cross-border purchasing has encountered many problems in the protection of consumers' rights and interests, such as consumers' right to know, the right to fair trade and so on. The main problem of which is difficult to return goods. This paper takes the consumption mode of online cross-border purchase and the right of unconditional cancellation as an example, through the applicability of unconditional revocation right in cross-border purchasing. Based on the analysis of the scope of application and the applicable conditions, this paper discusses the limitation and possibility of the unconditional revocation right in the new "Consumer Rights and interests Protection Law". Besides the preface and the conclusion, this paper is composed of the following four parts: the first chapter is "Overview of online cross-border purchase". This paper analyzes the characteristics of cross-border online purchasing, and discusses three forms of cross-border online purchasing, namely, private purchasing. The second chapter, "applicability of unconditional revocation right in cross-border purchasing", starts with the concept and nature of unconditional revocation right. This paper discusses the different views of academic circles on the application of unconditional revocation right in cross-border purchasing. The conclusion is that the application of the unconditional cancellation right is reasonable. Chapter three, "the scope of the unconditional revocation right in cross-border purchasing", analyzes the contract types of cross-border purchase. It is suggested that the scope of application of the existing unconditional rescission right should be extended to the service. And according to the nature of the goods in the daigou service, we make the exception clause of unconditional revocation right. Chapter 4th, "the applicable conditions of unconditional revocation right in cross-border purchase". This paper analyzes the subject and conditions of unconditional cancellation right in cross-border purchasing, clarifies the legal status of the three parties in the contract, and puts forward some suggestions for establishing the method of establishing the time limit for the exercise of unconditional revocation right.
