【摘要】：近年來,民族地區(qū)旅游業(yè)發(fā)展迅速,除了山清水秀的優(yōu)美環(huán)境外,民族文化的原汁原味最具吸引力,已成為我國(guó)旅游業(yè)的熱門地。民族旅游業(yè)的發(fā)展,是保護(hù)少數(shù)民族燦爛文化、開拓民族地區(qū)市場(chǎng)發(fā)展經(jīng)濟(jì)的重要舉措。國(guó)家支持民族地區(qū)旅游發(fā)展,特別是對(duì)少數(shù)民族村寨旅游開發(fā),隨著民族旅游業(yè)的大力推進(jìn),偏遠(yuǎn)落后的民族村寨逐漸被世人掀開了她神秘的面紗。打造民族村寨旅游是社會(huì)主義新農(nóng)村建設(shè)的重要組成部分,對(duì)于促進(jìn)民族地區(qū)經(jīng)濟(jì)發(fā)展,弘揚(yáng)少數(shù)民族文化,增強(qiáng)民族自豪感,鞏固和發(fā)展平等、團(tuán)結(jié)、互助、和諧的社會(huì)主義民族關(guān)系具有重要的意義。然而,在民族旅游業(yè)蓬勃發(fā)展的背后,民族村寨旅游開發(fā)與管理中產(chǎn)生的許多問題值得關(guān)注。本文選取民族村寨旅游發(fā)展較為成熟和典型的貴州西江千戶苗寨景區(qū)作為調(diào)研對(duì)象,針對(duì)西江千戶苗寨旅游開發(fā)與管理中存在的法律問題進(jìn)行分析并提出對(duì)策。本文的研究?jī)?nèi)容如下:第一章首先對(duì)調(diào)研地西江千戶苗寨的簡(jiǎn)介以及調(diào)研情況進(jìn)行闡述。其次將訪談?wù){(diào)研和問卷調(diào)研得到的信息進(jìn)行歸納與整理,其中較為重要的數(shù)據(jù)用圖表等形式展現(xiàn)。第二章是西江千戶苗寨旅游開發(fā)管理現(xiàn)狀以及存在的問題。通過調(diào)研,西江千戶苗寨旅游開發(fā)管理的現(xiàn)狀以及存在的問題包括四個(gè)方面:第一是旅游開發(fā)管理法律法規(guī)及配套政策不健全,并結(jié)合貴州省旅游法規(guī)及政策存在的問題進(jìn)行分析;第二是西江千戶苗寨旅游開發(fā)管理過程中執(zhí)法不力。原因是執(zhí)法依據(jù)不足、執(zhí)法主體多元化、執(zhí)法環(huán)境缺乏公共參與理念以及執(zhí)法監(jiān)督制度缺失導(dǎo)致。第三是西江千戶苗寨民族文化產(chǎn)權(quán)歸屬不明確。結(jié)合西江千戶苗寨民族文化產(chǎn)權(quán)歸屬現(xiàn)狀。提出西江千戶苗寨民族文化產(chǎn)權(quán)歸屬不明確的原因;第四,西江千戶苗寨利益分配機(jī)制不合理。西江千戶苗寨利益相關(guān)者分析,同時(shí)就西江千戶苗寨利益相機(jī)制存在的問題分析。第三章針對(duì)西江千戶苗寨旅游開發(fā)管理現(xiàn)狀及存在的問題,本文提出以下對(duì)策:第一,健全旅游開發(fā)管理法律法規(guī)及配套政策。及時(shí)構(gòu)建旅游開發(fā)管理法律法規(guī)體系,并適時(shí)制定相應(yīng)配套政策。第二、加強(qiáng)西江千戶苗寨旅游執(zhí)法。首先要完善旅游執(zhí)法依據(jù),使執(zhí)法工作有法可依。其次要明確行政管理權(quán)限劃分,避免執(zhí)法主體多元化問題。在推進(jìn)執(zhí)法主體隊(duì)伍建設(shè)的同時(shí),強(qiáng)化旅游執(zhí)法監(jiān)督。第三,建立民族文化產(chǎn)權(quán)制度。通過創(chuàng)建法律保障路徑、建設(shè)科學(xué)產(chǎn)權(quán)體系、設(shè)立民族文化產(chǎn)權(quán)評(píng)估機(jī)制等來解決這一問題。第四、優(yōu)化西江千戶苗寨利益分配機(jī)制。必須規(guī)范旅游收益分配機(jī)制、提高社區(qū)居民決策參與度,成立利益協(xié)調(diào)專項(xiàng)組織來緩解景區(qū)與居民的矛盾。
[Abstract]:In recent years, tourism in ethnic areas has developed rapidly. In addition to the beautiful environment of beautiful mountains and rivers, the original taste of national culture is the most attractive, and has become a hot spot of tourism in our country, the development of national tourism. It is an important measure to protect the splendid culture of minority nationalities and develop economy in minority areas. The state supports the development of tourism in minority areas, especially the tourism development of minority villages. With the vigorous promotion of ethnic tourism, the remote and backward ethnic villages gradually opened up her mysterious veil. Building the tourism of ethnic villages is an important part of the construction of new socialist countryside. It is of great significance to promote the economic development of ethnic areas, carry forward minority culture, strengthen national pride, consolidate and develop equality, unity, mutual assistance and harmonious socialist national relations. Behind the vigorous development of national tourism. Many problems in the tourism development and management of ethnic villages are worthy of attention. This paper selects the more mature and typical Guizhou Xijiang thousands of Miaozhai scenic spots as the research object. This paper analyzes the legal problems in the tourism development and management of thousands of Miaozhai households in Xijiang River and puts forward some countermeasures. The research contents of this paper are as follows:. In the first chapter, the brief introduction and survey situation of thousands of Miao villages in Xijiang are introduced. Secondly, the information obtained from interview and questionnaire survey is summarized and sorted out. One of the more important data in the form of charts and other forms. The second chapter is the Xijiang thousands of Miaozhai tourism development and management status and existing problems. Through research. The present situation and existing problems of tourism development and management of thousands of Miao villages in Xijiang include four aspects: first, the laws, regulations and supporting policies of tourism development and management are not perfect. And combined with Guizhou Province tourism laws and policies of the existing problems; The second is the lack of law enforcement in the process of tourism development and management of thousands of Miao villages in Xijiang. The reason is that the law enforcement basis is insufficient and the main body of law enforcement is diversified. The lack of public participation in the law enforcement environment and the lack of law enforcement supervision system lead to the third is the lack of clear ownership of national cultural property rights of thousands of Miao Zhai households in Xijiang River. The reasons for the unclear ownership of the national cultural property rights in Huomaozhai; In 4th, the benefit distribution mechanism of thousands of Miao Zhai households in Xijiang River was unreasonable. At the same time, the paper analyzes the problems existing in the benefit mechanism of thousands of Miao villages in Xijiang River. The third chapter puts forward the following countermeasures in view of the present situation and existing problems of tourism development and management of thousands of Miao villages in Xijiang River: first. Perfect tourism development management laws and regulations and supporting policies. Timely construction of tourism development management laws and regulations system, and timely formulation of appropriate supporting policies. Second. To strengthen the tourism law enforcement of thousands of Miaozhai households in Xijiang, first of all, we should improve the basis of tourism law enforcement, so that the law enforcement work can be based on the law. Secondly, we should make clear the division of administrative authority. To avoid the diversification of the subject of law enforcement. In order to promote the construction of the main body of law enforcement, strengthen the supervision of tourism law enforcement. Third, establish the system of national cultural property rights. Through the creation of legal protection path, the construction of scientific property rights system. Set up the evaluation mechanism of national cultural property right to solve this problem. 4th, optimize the benefit distribution mechanism of thousands of Miao village households in Xijiang. We must standardize the mechanism of tourism income distribution and improve the participation of community residents in decision-making. Set up special interest coordination organization to alleviate the contradiction between scenic area and residents.
