【摘要】：近年來,隨著我國經(jīng)濟(jì)的迅速發(fā)展和人們保險意識的不斷增強(qiáng),越來越多的家庭選擇購買保險作為家庭生活的風(fēng)險保障和理財投資方式,保險及其相關(guān)的財產(chǎn)性權(quán)益日益成為了家庭財產(chǎn)的重要組成部分,一些“巨額保險”更是具有巨大的經(jīng)濟(jì)價值,因此,在婚姻關(guān)系結(jié)束時如何分割這些保險財產(chǎn)顯得尤為重要。由于保險中的利益關(guān)系,特別是人身保險中的利益關(guān)系有時十分復(fù)雜,當(dāng)事人和法院在對這些保險財產(chǎn)進(jìn)行分割時往往感到無從下手,有時甚至直接退保分割保險費(fèi),造成了極大的損失,我國現(xiàn)行的《婚姻法》《保險法》等法律法規(guī)及相關(guān)的司法解釋中并沒有關(guān)于離婚時如何分割夫妻共同保險財產(chǎn)的規(guī)定,實(shí)踐中各地法官的處理方式也各不相同,造成類似案件卻有著不同甚至相反的處理結(jié)果。因此,對此問題進(jìn)行研究生整理,理清保險中的利益關(guān)系,明確認(rèn)定保險財產(chǎn)歸屬的依據(jù),具有十分重要的現(xiàn)實(shí)意義。理論界關(guān)于離婚時夫妻共同保險財產(chǎn)分割的研究較少,學(xué)者所持觀點(diǎn)也不盡相同,而且往往研究的指示關(guān)于財產(chǎn)保險成人保險中的某一方面或莫一特殊保險中的分割問題,缺乏全面系統(tǒng)的梳理,難以對司法實(shí)踐活動提供參考和幫助。本文采取文本分析法,比較分析法,價值分析法等方法,對搜集到的理論材料進(jìn)行整理和分析,以我國現(xiàn)行的《婚姻法》《保險法》《繼承法》等法律法規(guī)以及《婚姻法解釋(三)》等司法解釋為立足點(diǎn),進(jìn)行法學(xué)領(lǐng)域內(nèi)的跨學(xué)科研究,在多部門法律的交叉范圍內(nèi)探討夫妻保險財產(chǎn)的范圍、性質(zhì)、分割、依據(jù)等問題,尋求合理的解決方式,解決司法實(shí)踐中的困惑,保護(hù)婚姻當(dāng)事人的財產(chǎn)利益,促進(jìn)我國婚姻法的完善。
[Abstract]:In recent years, with the rapid development of China's economy and people's awareness of insurance are growing, more and more families choose to purchase insurance for family life risk protection and financial investment, insurance and property rights and interests related to become an important part of the family property, some "huge insurance" is great economic value, therefore, how to split the marriage between the end of the property insurance is very important. Because of insurance interests, especially in personal insurance interests sometimes is very complex, the parties and the courts often feel unable to start the segmentation of the property insurance, sometimes even directly surrender insurance division that caused great losses, China's current "marriage law" "insurance law" and other laws and regulations and the relevant judicial interpretations and not on divorce as segmentation Provisions for the couple's joint property insurance, handling throughout the practice of judges are different, resulting in similar cases have different or even opposite results. Therefore, research on students finishing this problem, clarify the relationship between the interests of insurance, insurance of property ownership clearly identified the basis, has very important practical significance. Research on divorce division of property insurance is less common, scholars have different views, and often indicates a research on property insurance insurance in the adult or Mo a special insurance in the segmentation problem, the lack of comprehensive and systematic analysis, to provide reference and help to the judicial practice. This paper uses text analysis, comparative analysis, value analysis and other methods, the theory of material collecting and analyzing the marriage law, "" to "" insurance law of China's current " Explain the inheritance law and other laws and regulations as well as < > > etc. (three) the marriage law judicial interpretation as foothold, interdisciplinary research in the field of law, to explore the scope of the insured property, couples in cross range multi sectoral law in nature, based on segmentation, and other issues, seek the means of reasonable solution, solve the judicial practice in the confusion, protecting the marriage party's property interests, promote the improvement of China's marriage law.
