【摘要】："有償網(wǎng)絡(luò)拼車"是互聯(lián)網(wǎng)服務(wù)與人們出行深度融合所形成的一種新型交通運行模式,但對其法律規(guī)制存在適法性判定沖突、安全權(quán)利保障沖突以及歸責(zé)原則的選擇沖突,沖突的原因在于立法缺失下法律價值選擇的矛盾。法律保障每個人在法律邊界內(nèi)的自由與完整,應(yīng)確定"有償網(wǎng)絡(luò)拼車"的合法性,并從規(guī)范"有償網(wǎng)絡(luò)拼車"定價行為、引入"有償網(wǎng)絡(luò)拼車"征信機制、側(cè)重"有償網(wǎng)絡(luò)拼車"安全權(quán)利保障等方面對其金習(xí)性規(guī)制。
[Abstract]:"paid network carpool" is a new mode of traffic operation formed by the fusion of Internet service and people's travel depth. However, there is a conflict of legal judgment on its legal regulation. The conflict of security rights and the choice of the principle of imputation is caused by the contradiction of the choice of legal value under the absence of legislation. The law guarantees the freedom and integrity of everyone within the legal boundary. It is necessary to determine the legality of "paid network carpool", and to introduce the "paid network carpool" credit investigation mechanism by standardizing the pricing behavior of "paid network ride-sharing". Focus on the "paid network ride-sharing" security rights and other aspects of its gold regulation.
