【摘要】：標(biāo)準(zhǔn)必要專利權(quán)人收取不公平許可費的行為可能在多方面損害競爭,反壟斷法規(guī)制這一行為的關(guān)鍵是認(rèn)定許可費收取的不公平性�？紤]到標(biāo)準(zhǔn)必要專利的獨特性并結(jié)合反壟斷實踐,分析標(biāo)準(zhǔn)必要專利許可費是否公平時可以參考的因素主要包括:標(biāo)準(zhǔn)必要專利的技術(shù)價值;符合相關(guān)標(biāo)準(zhǔn)的產(chǎn)品所承擔(dān)的整體許可費情況;標(biāo)準(zhǔn)必要專利的許可歷史或可比照的許可費標(biāo)準(zhǔn);相關(guān)標(biāo)準(zhǔn)必要專利所負(fù)擔(dān)的許可承諾;標(biāo)準(zhǔn)必要專利許可費的計費基礎(chǔ);禁令救濟行為的合理性;許可協(xié)議中是否包含導(dǎo)致許可費過高的其他不公平許可條件。在對不公平許可費進(jìn)行認(rèn)定時,還需要構(gòu)建或完善一些重要程序機制或保障機制,包括認(rèn)定主體的選擇、舉證責(zé)任的配置、相關(guān)披露制度的建立以及承諾制度的適用等。
[Abstract]:The standard essential patent holder's behavior of collecting unfair license fees may damage the competition in many ways. The key to regulate this behavior is to identify the inequity of license fees collection. Considering the unique standard essential patents and combining antitrust practice, factor analysis can refer to standard necessary patent licensing fees include: whether the fair value of technology standard essential patent licensing fees; the overall situation in accordance with the relevant standards for products; the standard necessary patent license or license fees according to historical standards; related standards essential patents on the basis of the necessary licensing commitment; billing standard patent licensing fees; rationality of injunctive relief behavior; the license agreement is contained in the license fee is too high lead to other unfair licensing conditions. When we identify the unfair license fee, we also need to establish or improve some important procedural mechanisms or safeguard mechanisms, including the selection of the identification body, the allocation of the burden of proof, the establishment of the relevant disclosure system and the application of the commitment system.
