【摘要】：出于增進(jìn)家庭福祉和婚姻收益的考慮,很多夫妻選擇了"男主外、女主內(nèi)"的家庭分工模式,多數(shù)丈夫在婚姻期間積累了較多的人力資本。而現(xiàn)行婚姻法所規(guī)定的共同財(cái)產(chǎn)制、家務(wù)勞動(dòng)補(bǔ)償制度、離婚經(jīng)濟(jì)幫助制度以及離婚損害賠償制度無(wú)法解決離婚時(shí)丈夫獨(dú)占婚姻期間新增人力資本的問(wèn)題,無(wú)法保護(hù)婦女的合法權(quán)益,降低了廣大婦女對(duì)婚姻的投資水平,不利于婚姻家庭的穩(wěn)定。人力資本產(chǎn)權(quán)具有明顯的可分性,在離婚時(shí)可以利用重置成本法對(duì)婚姻期間新增人力資本進(jìn)行價(jià)值評(píng)估并將其作為共同財(cái)產(chǎn)進(jìn)行分割。
[Abstract]:In order to promote the family welfare and the marriage income, many couples choose the family division mode of "male owner, female master", most husbands have accumulated more human capital during marriage. However, the common property system, the domestic work compensation system, the divorce economic assistance system and the divorce damage compensation system stipulated in the current Marriage Law cannot solve the problem of the husband's exclusive occupation of the new human capital during the marriage period. The inability to protect women's legal rights and interests reduces the level of women's investment in marriage and is not conducive to the stability of marriage and family. The property right of human capital has obvious separability. In divorce, the replacement cost method can be used to evaluate the value of new human capital during marriage and divide it into common property.
