【摘要】：陜甘寧邊區(qū)的婚姻立法,確立了“男女婚姻自由”的原則。在司法實(shí)踐中,陜甘寧邊區(qū)高等法院通過(guò)對(duì)婚約的適度保護(hù),對(duì)離婚自由的適當(dāng)限制,尤其是對(duì)童養(yǎng)媳的堅(jiān)決取締以及對(duì)寡婦再嫁的支持和保護(hù),使婚姻自由原則與陜甘寧邊區(qū)的社會(huì)實(shí)際相互契合。陜甘寧邊區(qū)高等法院司法檔案,為我們考察陜甘寧邊區(qū)處理婚姻糾紛的實(shí)踐與經(jīng)驗(yàn),提供了可能。在司法實(shí)踐中,一項(xiàng)具體的法律原則所包含的內(nèi)容,應(yīng)當(dāng)與特定時(shí)期的政治、經(jīng)濟(jì)、文化狀況保持一致,并隨著社會(huì)的發(fā)展進(jìn)步,靈活地予以調(diào)整。司法檔案具有幫助理解法律存在的社會(huì)基礎(chǔ)、反映制定法命運(yùn)、解讀立法內(nèi)涵的作用。
[Abstract]:The marriage legislation of Shaanxi-Kansu-Ningxia Border region established the principle of "freedom of marriage between men and women". In judicial practice, the Supreme Court of the Shensi-Kansu-Ningxia Border region, through the proper protection of marriage contracts, the appropriate restrictions on the freedom of divorce, especially the firm ban on child brides, and the support and protection of widows' remarriage. The principle of freedom of marriage and the social reality of the Shaanxi-Kansu-Ningxia Border region coincide with each other. The judicial file of the Supreme Court of Shaanxi, Gansu and Ningxia provides us with the possibility to investigate the practice and experience in dealing with marital disputes in Shaanxi, Kansu-Ningxia Border region. In judicial practice, the contents of a specific legal principle should be consistent with the political, economic and cultural conditions of a specific period, and be adjusted flexibly with the development and progress of society. Judicial archives have the function of understanding the social basis of the existence of law, reflecting the fate of law making and interpreting the connotation of legislation.
