【摘要】： 對(duì)婦女的家庭暴力是世界各國(guó)普遍存在的社會(huì)現(xiàn)象,也是當(dāng)今國(guó)際社會(huì)普遍關(guān)注的世界性婦女問(wèn)題之一。作為一種落后、野蠻的社會(huì)痼疾,其是實(shí)現(xiàn)全球男女平等和婦女人權(quán)的最大障礙。 根據(jù)全國(guó)婦聯(lián)權(quán)益部門(mén)的統(tǒng)計(jì),我國(guó)30%的家庭存在不同程度的暴力行為,施暴者多為男性。2001年,新的婚姻法出臺(tái),增加了關(guān)于家庭暴力的禁止性規(guī)定。家庭暴力已經(jīng)成為人們?cè)絹?lái)越關(guān)注的話題。然而由于目前我國(guó)與家庭暴力相配套的法律制度尚不健全,對(duì)家庭暴力的界定和對(duì)家庭暴力行為性質(zhì)的認(rèn)定仍存在諸多爭(zhēng)議,家庭暴力至今還未得到有效的制止。日益嚴(yán)重的家庭暴力危害了受害者的身心健康,侵犯了受害者的合法權(quán)益,破壞了社會(huì)的穩(wěn)定和發(fā)展,已引起全社會(huì)的廣泛關(guān)注。 基于此,筆者就此問(wèn)題展開(kāi)論述,以期社會(huì)各界充分認(rèn)識(shí)預(yù)防和制止家庭暴力的重要意義。本文試圖通過(guò)國(guó)內(nèi)外對(duì)家庭暴力的不同認(rèn)識(shí)、現(xiàn)狀、產(chǎn)生原因等方面的比較研究,分析和總結(jié)我國(guó)及國(guó)外在預(yù)防和制裁家庭暴力方面的一些做法、經(jīng)驗(yàn),并針對(duì)存在的問(wèn)題和不足,結(jié)合本地區(qū)的實(shí)際,就如何進(jìn)一步樹(shù)立兩性平等理念、健全法律法規(guī)、完善社會(huì)綜合治理等方面工作進(jìn)行探討,以期切實(shí)起到預(yù)防和制止家庭暴力的發(fā)生,從根本上維護(hù)和保障婦女的合法權(quán)益。論文還通過(guò)實(shí)證分析的方法,通過(guò)相關(guān)的調(diào)查問(wèn)卷、數(shù)據(jù)比較,進(jìn)一步分析本地區(qū)在預(yù)防和制止家庭暴力方面所作出的努力。 論文共分五個(gè)章節(jié),按照提出問(wèn)題、分析問(wèn)題和解決問(wèn)題的邏輯展開(kāi),分為緒論、現(xiàn)狀、原因分析、已有做法和對(duì)策研究。第一部分緒論主要概述論文選題的背景、目的和意義、國(guó)內(nèi)外研究現(xiàn)狀,闡明本論文的研究思路。第二部分主要根據(jù)國(guó)內(nèi)外對(duì)家庭暴力的不同認(rèn)識(shí)以及法律的界定,進(jìn)一步明確家庭暴力的概念,并對(duì)家庭暴力的表現(xiàn)特點(diǎn)和發(fā)展趨勢(shì)進(jìn)行了分析,進(jìn)一步揭示當(dāng)前家庭暴力現(xiàn)象的普遍性。第三部分主要是對(duì)國(guó)內(nèi)外家庭暴力產(chǎn)生的不同原因分別進(jìn)行分析,既有傳統(tǒng)觀念的因素,也有社會(huì)的原因,包括心理的根源。同時(shí)對(duì)家庭暴力的社會(huì)危害進(jìn)行了概括。第四部分對(duì)我市及我區(qū)的一些做法進(jìn)行了總結(jié),并列舉了國(guó)外的一些經(jīng)驗(yàn),同時(shí)指出當(dāng)前在預(yù)防和制止家庭暴力工作中存在的問(wèn)題和不足。第五部分在總結(jié)本地區(qū)做法和國(guó)外經(jīng)驗(yàn)的基礎(chǔ)上,提出當(dāng)前和今后一段時(shí)間內(nèi),在預(yù)防和制裁家庭暴力工作中的對(duì)策措施,包括加強(qiáng)立法、健全機(jī)制、提高素質(zhì)等,供相關(guān)部門(mén)予以借鑒和參考。
[Abstract]:Domestic violence against women is a universal social phenomenon all over the world. As a backward, savage social malady, it is the biggest obstacle to the realization of gender equality and women's human rights. According to the statistics of the All-China Women's Federation (ACWF), 30% of the families in China have different levels of violence, and the perpetrators are mostly men. In 2001, the new Marriage Law was enacted, which increased the prohibition of domestic violence. Domestic violence has become a topic of increasing concern. However, there are still many disputes on the definition of domestic violence and the determination of the nature of domestic violence, and the domestic violence has not yet been effectively stopped because of the fact that the legal system supporting domestic violence in our country is still not perfect. The increasingly serious domestic violence endangers the physical and mental health of the victims, infringes on the legitimate rights and interests of the victims, undermines the stability and development of the society, and has aroused widespread concern of the whole society. Based on this, the author discusses this issue in order to fully understand the importance of preventing and suppressing domestic violence. This paper attempts to analyze and sum up some practices and experiences of preventing and punishing domestic violence in China and abroad through the comparative study of different understanding, present situation and causes of domestic violence at home and abroad. In the light of the existing problems and shortcomings and the reality of the region, this paper discusses how to further establish the concept of gender equality, improve laws and regulations, and improve comprehensive social management, and so on. In order to effectively prevent and stop the occurrence of domestic violence, fundamentally protect and protect the legitimate rights and interests of women. The paper also through the empirical analysis method, through the correlation questionnaire, the data comparison, further analyzes the local area in the prevention and the suppression domestic violence aspect to make the effort. The paper is divided into five chapters, according to the logic of problem raising, problem analysis and problem solving, it is divided into introduction, current situation, reason analysis, existing practice and countermeasure research. The first part of the introduction mainly summarizes the background, purpose and significance of the topic, domestic and foreign research status, clarify the research ideas of this paper. In the second part, according to the different understanding of domestic violence and the definition of law at home and abroad, the concept of domestic violence is further clarified, and the characteristics and development trend of domestic violence are analyzed. Further reveal the prevalence of the current phenomenon of domestic violence. The third part mainly analyzes the different causes of domestic violence at home and abroad, including the traditional concept of factors, but also the social reasons, including the root of psychology. At the same time, the social harm of domestic violence is summarized. The fourth part summarizes some practices of our city and our district, enumerates some experiences of foreign countries, and points out the existing problems and shortcomings in preventing and suppressing domestic violence at present. The fifth part, on the basis of summing up the regional practice and foreign experience, puts forward the countermeasures in preventing and sanctioning domestic violence, including strengthening legislation, improving mechanism and improving quality, etc. For the relevant departments to reference and reference.
