【摘要】：我國重視家庭暴力問題,在《婚姻法》、《未成年人保護(hù)法》等相關(guān)法律對家暴問題進(jìn)行規(guī)定。特別是我國2016年3月1日開始實施的《中華人民共和國反家庭暴力法》,是我國首部專門針對家庭暴力進(jìn)行規(guī)定的法律。近年來針對針對未成年人家庭暴力的狀況仍較為突出,但從充分保護(hù)未成年人角度出發(fā),我國現(xiàn)行法律針對未成年人家暴的相關(guān)規(guī)定仍存有不完善之處,如針對未成年人家庭暴力問題的立法比較分散,缺乏統(tǒng)一規(guī)定;針對未成年人家庭暴力問題規(guī)定存在不足,缺乏未成年人人視角;針對未成年人家庭暴力救濟措施規(guī)定在司法實踐中可操作性差。因此,如何建立有效地防治對未成年人家庭暴力的法律制度,這對于保護(hù)未成年人的健康成長、維護(hù)家庭和諧和促進(jìn)社會穩(wěn)定具有重要的理論和現(xiàn)實意義。論文建議從加大法律教育宣傳,增強人們法律知識,改變傳統(tǒng)觀念;完善立法,充分體現(xiàn)未成年人視角;完善對未成年人家庭暴力的救濟措施等方面進(jìn)一步防治針對未成年人的家庭暴力問題。
[Abstract]:Our country pays attention to the domestic violence problem, in the marriage law, the minor protection law and so on related law carries on the stipulation to the domestic violence question. In particular, the Anti-domestic violence Law of the people's Republic of China, which has been implemented since March 1, 2016, is the first law in China to specifically regulate domestic violence. In recent years, the situation of domestic violence against minors is still prominent, but from the perspective of adequate protection of minors, there are still some imperfections in the relevant provisions of the current laws on domestic violence against minors. For example, the legislation on domestic violence of minors is scattered and lack of uniform regulations, and the provisions on domestic violence against minors are insufficient and lack the perspective of minors. Domestic violence relief measures for minors in the judicial practice of poor operability. Therefore, how to establish an effective legal system to prevent and cure domestic violence against minors has important theoretical and practical significance for protecting minors' healthy growth, maintaining family harmony and promoting social stability. The paper suggests to strengthen legal education and publicity, strengthen people's legal knowledge, change traditional concepts, perfect legislation, and fully reflect the perspective of minors. Improve domestic violence against minors and other measures to further prevent domestic violence against minors.
