【摘要】：在現(xiàn)代社會(huì)的婚姻關(guān)系中,因第三者插足致使婚姻關(guān)系破裂的現(xiàn)象正在逐漸增多。秉持在婚姻關(guān)系中雙方應(yīng)當(dāng)相互忠誠(chéng)的原則,越來(lái)越多的夫妻選擇以訂立夫妻忠誠(chéng)協(xié)議的方式來(lái)保護(hù)自己的婚姻。對(duì)于什么是"夫妻忠誠(chéng)協(xié)議",目前學(xué)界還沒(méi)有統(tǒng)一的概念界定;對(duì)于忠誠(chéng)協(xié)議的法律性質(zhì),從當(dāng)前的發(fā)展?fàn)顩r來(lái)看,屬于以身份關(guān)系為主并涉及財(cái)產(chǎn)關(guān)系的無(wú)名協(xié)議;對(duì)于夫妻忠誠(chéng)協(xié)議的法律效力,司法實(shí)踐中也沒(méi)有統(tǒng)一的判定標(biāo)準(zhǔn),導(dǎo)致了諸多同案不同判現(xiàn)象的存在,影響了法律的權(quán)威。關(guān)于夫妻忠誠(chéng)協(xié)議的糾紛具有較強(qiáng)的家庭屬性,司法不適合強(qiáng)行介入,此種情形下引入自然之債這一理論對(duì)夫妻忠誠(chéng)協(xié)議進(jìn)行分析,恰好可以解決夫妻忠誠(chéng)協(xié)議的效力判定問(wèn)題。
[Abstract]:In modern society, the phenomenon of marriage breakdown caused by the third party is increasing gradually. In accordance with the principle that both parties should be faithful to each other in marriage, more and more couples choose to protect their marriage by entering into a marital loyalty agreement. At present, there is no uniform definition of what is "the agreement of husband and wife loyalty", and the legal nature of the agreement of loyalty belongs to the nameless agreement concerning the relationship of identity and property. As for the legal effect of the agreement of husband and wife loyalty, there is no uniform judgment standard in judicial practice, which leads to the existence of many different judgments in the same case and affects the authority of the law. The dispute about the agreement of husband and wife loyalty has strong family attribute, the judicature is not suitable for forcible intervention, under such circumstances, the theory of natural debt is introduced to analyze the agreement of loyalty of husband and wife. It can solve the validity of the loyalty agreement between husband and wife.
