【摘要】：本文對(duì)現(xiàn)行婚姻法的司法解釋和法學(xué)界所一致認(rèn)同的“判斷夫妻感情是否確已破裂，，應(yīng)當(dāng)從婚姻基礎(chǔ)、婚后感情、離婚原因、夫妻關(guān)系的現(xiàn)狀和有無(wú)和好的可能等方面綜合分析”提出質(zhì)疑，并指出只有“有無(wú)和好可能”才是判斷“夫妻感情是否確已破裂”的唯一標(biāo)準(zhǔn)，確認(rèn)“有無(wú)和好可能”的應(yīng)是婚姻當(dāng)事人尤其是原告方而并非為法官。本文還對(duì)婚姻法修改中的離婚法定理由及其防止隨意離婚、保障無(wú)過(guò)失方和子女權(quán)益的立法操作化提出具體建議。
[Abstract]:In this paper, the judicial interpretation of the current marriage law and the consensus in the field of law that "judging whether the feelings of husband and wife have indeed broken down should be based on the basis of marriage, the feelings after marriage, and the reasons for divorce." A comprehensive analysis of the current situation and the possibility of harmony between husband and wife "raises questions, and points out that only" there is a possibility of harmony "is the only criterion for judging" whether or not the relationship between husband and wife has really broken down. " It is the parties to the marriage, especially the plaintiff, and not the judge, who confirm the possibility of reconciliation. This paper also puts forward some concrete suggestions on the legal reasons of divorce in the revision of Marriage Law and its prevention of arbitrary divorce and the legislative operation of protecting the rights and interests of the no-fault party and the children.
