【摘要】：隨著人們生活水平的提高,家庭財(cái)富也日益增長(zhǎng),親子間的財(cái)產(chǎn)關(guān)系必然也法生了變化,趨于復(fù)雜化。例如子女接受他人的贈(zèng)與和拾得遺失物以及子女憑借自身勞動(dòng)能力而從事職業(yè)獲得報(bào)酬等情況,而對(duì)于這些財(cái)產(chǎn),未成年人父母能否加以管理以及擁有何種權(quán)利需承擔(dān)何種義務(wù)等在婚姻法中未進(jìn)行明確系統(tǒng)的規(guī)制。 當(dāng)前,我國(guó)雖已建立了未成年人基本法律保護(hù)體系,未成年人受撫養(yǎng)、受教育等權(quán)利有了較為明確的規(guī)定,但在未成年人財(cái)產(chǎn)權(quán)保護(hù)方面卻存在立法上體系散亂、條文多為原則性規(guī)定,內(nèi)容過(guò)于抽象等缺陷。從有關(guān)婚姻家庭法方向研究學(xué)者的學(xué)術(shù)專著和期刊論文中,我們可以發(fā)現(xiàn)對(duì)于離異家庭未成年人財(cái)產(chǎn)權(quán)利及保護(hù)制度方面的關(guān)注不是很多,學(xué)者們關(guān)注更多的是未成年子女監(jiān)護(hù)撫養(yǎng)問(wèn)題,若是有提及此問(wèn)題也并無(wú)設(shè)專章具體詳盡的論述,總體上比較滯后。保障離異家庭未成年子女的財(cái)產(chǎn)權(quán)利是保障其今后生活的首要基礎(chǔ),但離異家庭未成年子女財(cái)產(chǎn)權(quán)利保護(hù)問(wèn)題是目前我國(guó)民法、婚姻家庭法的一個(gè)立法薄弱點(diǎn),相關(guān)規(guī)定不完備。遂本文擬從我國(guó)對(duì)離異家庭未成年子女財(cái)產(chǎn)權(quán)利立法缺陷出發(fā),結(jié)合域外相關(guān)法律規(guī)定,試提出完善有關(guān)我國(guó)離異家庭未成年子女財(cái)產(chǎn)制度立法的相關(guān)建議和舉措。
[Abstract]:With the improvement of people's living standard, family wealth is increasing day by day, and the property relationship between parents and children will inevitably change and become more complicated. For example, in the case of children receiving gifts from others and picking up lost property, and if their children are paid for their work by virtue of their ability to work, and in the case of such property, Whether the parents of minors can be regulated and what kind of rights and obligations should be assumed are not regulated systematically in the Marriage Law. At present, although China has established a basic legal protection system for minors, the rights of minors' maintenance and education have been clearly stipulated, but in the protection of minors' property rights, there is a scattered legislative system. The provisions are mostly in principle, and the contents are too abstract and so on. From the academic monographs and journal papers of scholars on the direction of marriage and family law, we can find that there is not much concern about the property rights and protection system of minors from divorced families. Scholars pay more attention to the problem of custody and maintenance of minor children. The protection of the property rights of minor children in divorced families is the primary basis for their future life. However, the protection of the property rights of minor children in divorced families is a weak point of legislation in China's civil law and marriage and family law at present. The relevant regulations are incomplete. Therefore, this article intends to set out from our country to divorce family minor child property right legislation flaw, unifies the extraterritorial correlation law stipulation, tries to propose the consummation regarding our country divorce family minor child property system legislation related suggestion and the measure.
