【摘要】：在民法的倫理人格及抽象的倫理技術(shù)掩蓋下,女性的人格權(quán)從未真正平等地得以實(shí)現(xiàn),而女性財(cái)產(chǎn)權(quán)益弱化是關(guān)鍵原因。只有以性別視角重新審視當(dāng)代法律,加強(qiáng)對(duì)女性的特殊保護(hù),才能為其人格權(quán)的平等實(shí)現(xiàn)提供經(jīng)濟(jì)保障,最終實(shí)現(xiàn)人格平等在自然法與實(shí)在法上的統(tǒng)一。
[Abstract]:Under the cover of the ethical personality of civil law and abstract ethical technology, women's personality rights have never been realized equally, and the weakening of women's property rights and interests is the key reason. Only by re-examining contemporary law from a gender perspective and strengthening the special protection of women can we provide economic guarantee for the equal realization of personality rights and finally realize the unity of personality equality between natural law and positive law.
