【摘要】：《民法總則》規(guī)定了意定監(jiān)護制度,這符合人權保障理念和民法發(fā)展趨勢。但在實際操作中還需完善意定監(jiān)護合同,明確主體范圍特別是監(jiān)護人為單位組織的情形,明確合同成立與生效要符合的程序要件如公證和登記;此外,還要建立意定監(jiān)護監(jiān)督制度,但要明確只有監(jiān)護人與被監(jiān)護人無親屬關系或者是單位組織時才有必要設立監(jiān)督。
[Abstract]:The General principles of Civil Law stipulate the system of optional guardianship, which accords with the concept of human rights protection and the development trend of civil law. However, in practice, it is necessary to perfect the contractual guardianship contract, clarify the scope of the subject, especially the situation in which the guardian is organized as a unit, and make clear the procedural requirements such as notarization and registration to be complied with when the contract is formed and effective; in addition, But it is necessary to establish supervision system only when guardian and guardian have no kinship or unit organization.
