離婚糾紛中按揭房屋權(quán)屬問題研究

【摘要】:房屋乃人之安身立命之本,其使用價(jià)值歷來(lái)為人們所看重;诎簿訕窐I(yè)的傳統(tǒng)觀念,購(gòu)置房屋是大多數(shù)家庭的頭等大事,因此這項(xiàng)不動(dòng)產(chǎn)在家庭財(cái)產(chǎn)中占據(jù)著較大比重。目前,由于土地資源稀缺,房產(chǎn)價(jià)格不斷飆升,在這樣的背景下,人們更加看重房屋的價(jià)值,由此引發(fā)的糾紛也日益增多。在眾多的離婚糾紛中,按揭房屋的權(quán)屬問題是一個(gè)熱點(diǎn)。但是這一熱點(diǎn)目前面臨立法的粗疏與理念的沖突,已逐漸成為了困擾司法實(shí)踐的難題。因此,本文對(duì)于涉及按揭房屋在離婚糾紛中處理的法律問題的研究具有重要的現(xiàn)實(shí)價(jià)值。考慮到約定財(cái)產(chǎn)制下按揭房屋的定性和處理相對(duì)比較容易,且司法實(shí)踐中的問題絕大多數(shù)發(fā)生在法定財(cái)產(chǎn)制場(chǎng)合,故本文的探討僅限于法定財(cái)產(chǎn)制的背景下。本文有五章,全面系統(tǒng)地研究了夫妻財(cái)產(chǎn)中以按揭方式購(gòu)買的房屋在離婚時(shí)的權(quán)屬分割問題。第一章緒論,介紹本論文的研究背景及意義,國(guó)內(nèi)外文獻(xiàn)綜述及研究方法。第二章對(duì)房屋按揭制度予以概述。按揭房屋的處理之所以會(huì)成為離婚財(cái)產(chǎn)分割時(shí)的難點(diǎn)所在,最主要是由按揭制度本身的復(fù)雜性所決定的,它包括三方主體,四種法律關(guān)系,厘清按揭制度下的各種法律關(guān)系,是解決按揭房屋權(quán)屬問題的前提。本章主要介紹了房屋按揭的定義、房屋按揭的法律性質(zhì)、房屋增值部分的法律性質(zhì)及對(duì)其分割的正當(dāng)性等相關(guān)理論。第三章介紹離婚時(shí)按揭房屋權(quán)屬之爭(zhēng)的原因。主要原因有財(cái)產(chǎn)法與身份法中財(cái)產(chǎn)權(quán)屬確定規(guī)則之間存在沖突;離婚糾紛中按揭權(quán)屬之爭(zhēng)類型化具有多樣化;按揭房屋與尚未取得所有權(quán)和尚未取得完全所有權(quán)房屋概念的混同;婚姻期間個(gè)人財(cái)產(chǎn)的增值部分如何分割存在爭(zhēng)議以及沒有明確的法律規(guī)定導(dǎo)致各地方判決產(chǎn)生矛盾等。第四章主要針對(duì)不同情形下離婚時(shí)按揭房屋出現(xiàn)的情況進(jìn)行類型化分析,將其分為四種情形進(jìn)行探討。第五章構(gòu)建適合我國(guó)國(guó)情的離婚按揭房屋歸屬制度。首先對(duì)最高人民法院關(guān)于適用《中華人民共和國(guó)婚姻法》若干問題的解釋[三](征求意見稿)第13條進(jìn)行分析,提出該建議稿存在的問題,如將購(gòu)房款超過房屋總價(jià)款的一半成為判斷該房屋為個(gè)人財(cái)產(chǎn)的核心因素不盡合理,共同還貸部分返還內(nèi)容不甚清晰等,筆者認(rèn)為對(duì)這一問題的處理應(yīng)考慮離婚時(shí)夫妻財(cái)產(chǎn)分割的原則尤其對(duì)婦女權(quán)益的保護(hù),其次探討了司法實(shí)踐中我國(guó)按揭房屋在離婚時(shí)的具體分割辦法,包括按揭房屋被認(rèn)定為個(gè)人財(cái)產(chǎn)時(shí),對(duì)增值部分處理的問題研究。
[Abstract]:Housing is the basis of people's lives, its use value has always been valued by people. Based on the traditional idea of living and working, buying a house is the top priority of most families, so the real estate occupies a large proportion of the family property. At a time when land is scarce and property prices are soaring, the value of homes has become more valued and disputes are growing. In many divorce disputes, mortgage housing ownership is a hot spot. However, this hot spot is now facing the conflict between legislation and ideas, which has gradually become a difficult problem puzzling judicial practice. Therefore, this paper has important practical value for the study of legal issues concerning mortgage housing in divorce disputes. Considering that it is relatively easy to define and deal with the mortgage house under the contract property system, and the problems in judicial practice mostly occur in the situation of legal property system, the discussion in this paper is limited to the background of legal property system. There are five chapters in this paper, which comprehensively and systematically study the division of ownership in the divorce of the house purchased by mortgage in the property of husband and wife. The first chapter introduces the research background and significance of this paper, literature review and research methods at home and abroad. The second chapter gives an overview of the housing mortgage system. The reason why the processing of mortgage housing becomes the difficulty in the division of divorced property is mainly determined by the complexity of the mortgage system itself. It includes three parties, four kinds of legal relations, and clarifies various legal relationships under the mortgage system. Is to solve the mortgage housing ownership problem premise. This chapter mainly introduces the definition of the housing mortgage, the legal nature of the value-added part of the house and the legitimacy of the division. The third chapter introduces the reason of the dispute about the ownership of mortgage house when divorce. The main reasons are the conflict between the property law and the property right determination rule in the status law, the diversification of the type of mortgage ownership in the divorce dispute. The concept of mortgage house is mixed with the concept of house that has not yet acquired ownership or has not yet acquired full ownership; there are disputes on how to divide the value-added part of personal property during marriage and the lack of clear legal provisions leads to contradictions among local judgments and so on. The fourth chapter mainly analyzes the situation of mortgage house under different circumstances, and divides it into four situations. The fifth chapter constructs the divorce mortgage housing ownership system suitable for our country's national conditions. First of all, the article 13 of the interpretation of the Supreme people's Court concerning the application of the Marriage Law of the people's Republic of China [3] (draft for solicitation of opinions) is analyzed, and the problems existing in the proposal are put forward. If buying more than half of the total house price becomes the core factor in judging the house as personal property, and the contents of the return of the joint repayment of the loan are not very clear, etc. The author thinks that the principle of divorce should be taken into account, especially the protection of women's rights and interests. Secondly, the author discusses the concrete method of dividing the mortgage house in the judicial practice. Including mortgage housing is recognized as personal property, the value-added part of the problem.
