【摘要】：本文的主要研究對象是童養(yǎng)媳這一特殊的婚姻形態(tài),主要依據(jù)龍泉司法檔案中的70個童養(yǎng)媳相關案件,對童養(yǎng)媳婚姻進行全面的剖析。尤其是從前人涉及較少的法律視角,來看待童養(yǎng)媳問題,分析童養(yǎng)媳的法律地位和法律關系,并從中看到民間習慣與國家法律、意識形態(tài)之間的聯(lián)系。 在探討這些問題前,本文首先總結(jié)前人的研究成果,對童養(yǎng)媳的起源問題、明清時期的發(fā)展狀況,其婚儀婚俗有充分的了解。同時,對本文的主要材料一龍泉司法檔案中的70個案件進行整理,從收案時間、案情、結(jié)果等幾個方面對龍泉的童養(yǎng)媳案件進行全面分析。并以案中的童養(yǎng)媳為研究對象,總結(jié)她們的抱養(yǎng)年齡、結(jié)婚年齡、現(xiàn)實年齡和婚姻質(zhì)量等。通過檔案中所描繪的童養(yǎng)媳生活,講述童養(yǎng)媳的人生。 與此同時,本文依據(jù)龍泉司法檔案的司法實踐,從法律視角來分析童養(yǎng)媳的婚姻。由于傳統(tǒng)時代和民國時期的法律中均沒有有關童養(yǎng)媳的規(guī)定。本章采用清代的《刑案匯覽》和民國的龍泉司法檔案中的司法實踐,來探討童養(yǎng)媳法律地位的變化。童養(yǎng)媳的司法判定經(jīng)歷了從清代時比照其他身份到民國時以婚約判定的變化。其中經(jīng)歷了民國時期的婦女運動,使得童養(yǎng)媳的地位有一定提高,國民政府頒布的法律中,出現(xiàn)了有利于童養(yǎng)媳的變化,婚約從北洋時期的有效變?yōu)榱藷o效。 自童養(yǎng)媳出現(xiàn)以來,士人對其爭論一直存在。其制度本身與法不合,且童養(yǎng)媳本人的悲慘境遇,使得童養(yǎng)婚常受到清代士人的批判。而近代以后,婚姻自由的觀念逐漸深入人心,童養(yǎng)媳作為舊社會殘害婦女的惡習遭到嚴厲的批評。童養(yǎng)媳的悲慘生活和反抗,及時人呼吁女權(quán)的聲音,常常出現(xiàn)在民國時期的文學作品中。在中國共產(chǎn)黨的法律體系中,由于意識形態(tài)的關系,對童養(yǎng)媳采取嚴禁的措施。隨著新中國的成立,童養(yǎng)媳逐漸退出了歷史舞臺。然而,童養(yǎng)媳這一民間習慣,在古代倫理、近代法律都不曾允許的情況下存在了這么長時間,與現(xiàn)實的需要、政府的默許有莫大的聯(lián)系。
[Abstract]:The main research object of this paper is the special marriage form of child - in - law , which is mainly based on 70 cases of child - law - in - law in Longquan judicial file , and makes a comprehensive analysis of the marriage of child - in - law .

Before discussing these problems , this paper first summarizes the previous research results , the origin of the child - in - law , the development of the Ming and Qing Dynasties , and the marriage custom of the marriage instrument . At the same time , the author makes a comprehensive analysis of the cases of child - in - law in Longquan from aspects of time , case and result .

At the same time , according to the judicial practice of the judicial file of Longquan , this article analyzes the marriage of the child - in - law from the angle of law . Because of the traditional age and the law of the Republic of China , there is no change in the legal status of the child - law - in - law .

Since the appearance of the child - in - law , the scholar has always been in dispute with his argument . The system itself is incompatible with the law , and the child ' s daughter - in - law has been criticized by the Qing Dynasty . In modern times , the idea of marriage freedom has gradually been criticized . With the establishment of the new China , the child - in - law has gradually withdrawn from the historical stage .
