【摘要】:對于具有傳統(tǒng)家庭觀念的中國人來說,擁有房產(chǎn)不僅是居住的需要,更是生活穩(wěn)定的象征和心理安穩(wěn)的保障。飛速發(fā)展的現(xiàn)代社會給了人們機遇,同樣也帶來無盡的壓力。飆升的房價使許多人不得不望房興嘆。伴隨著離婚案件數(shù)量的不斷上升,關于離婚時房屋權屬糾紛也日益焦灼。通過對離婚房屋權屬認定案件的分析認為,對于離婚案件中紛繁的房產(chǎn)權屬認定最好的梳理手段就是對其進行分類。按照購置形式進行分類,房屋可以分為房改房、商品房、自建房等。本文通過將房屋購置形式與房屋登記所有人相結(jié)合的方式,分類加以論述離婚時房屋權屬認定問題。當然,列舉并不能窮盡紛繁復雜的現(xiàn)實,在此只論述夫妻離婚時房屋權屬認定的一些熱點問題。 關于商品房離婚時房屋權屬認定,婚前或者婚后全額購房及按揭購房的情況可以細化為幾十種不同的出資和所有權形式。由于篇幅有限,本文僅選取社會實踐中發(fā)生次數(shù)較多,爭議較大的幾種情形加以分析總結(jié)。通過列舉典型司法案例,相關法律分析,司法實踐中的不足與完善三方面探討這一房屋形式下夫妻離婚房屋權屬認定問題。 關于房改房離婚時房屋權屬認定,,將房改房根據(jù)婚前和婚后取的不同情形分為兩種情形加以論述。房改房作為我國特定時期的特殊房屋所有形式,為我國社會主義建設,維護社會穩(wěn)定人民生活做出巨大貢獻。隨著社會發(fā)展,房改房政策正逐漸退出歷史舞臺,然而伴隨房改房產(chǎn)生的夫妻離婚時房屋權屬認定問題仍然存在。本文選取婚前取得房改房和婚后取得房改房的兩種情形,分析夫妻離婚時房改房的權屬認定。 幾種特殊房屋形式下夫妻離婚時房屋權屬認定,包括房屋登記在未成年子女名下夫妻離婚時房屋權屬認定,拆遷安置房和小產(chǎn)權房在離婚時房屋權屬認定實踐中的具體操作。拆遷安置房和小產(chǎn)權房在房屋體系中仍占據(jù)非常大的比重。這些房屋由于產(chǎn)權不明確或者說根本就暫時沒有產(chǎn)權,產(chǎn)權形式復雜,在離婚房屋權屬認定中是難點所在。本文僅從實踐操作的角度,簡要介紹這兩種情形。
[Abstract]:For Chinese with traditional family concept, owning a house is not only a living need, but also a symbol of life stability and a guarantee of psychological stability. The rapid development of modern society has given people opportunities, but also brought endless pressure. Soaring house prices have forced many people to lament. With the increasing number of divorce cases, the housing ownership disputes become increasingly anxious. Through the analysis of the divorce housing ownership cases, it is concluded that the best way to identify the complex property ownership in divorce cases is to classify them. According to the form of purchase classification, housing can be divided into housing reform, commercial housing, and so on. In this paper, by combining the form of house purchase and the owner of the house registration, the paper discusses the problem of the confirmation of the ownership of the house at the time of divorce. Of course, enumeration can not be exhaustive of complicated reality, here only discusses some hot issues of house ownership in the divorce of husband and wife. About the commercial house divorce time house property right ascertains, before marriage or after marriage the full purchase house and the mortgage purchase situation may be refined into dozens of different forms of investment and ownership. Due to limited space, this paper only selects the social practice of a number of times, controversial several situations to be analyzed and summarized. Through the enumeration of typical judicial cases, relevant legal analysis, judicial practice in the deficiencies and perfection of the three aspects of this form of housing divorce husband and wife to determine the ownership of housing. On the right of house ownership in divorce, housing reform is divided into two situations according to the different situations before and after marriage. As a special form of housing in a specific period of our country, housing reform contributes greatly to the socialist construction and the maintenance of social stability. With the development of society, the housing reform policy is gradually withdrawing from the historical stage. In this paper, the author analyzes the ownership of the house reform when the husband and wife divorce by choosing the two situations of obtaining the house reform before marriage and the house reform after the marriage. Several kinds of special housing forms under the couple divorce when the house ownership confirmation, including the house registration in the minor children name husband and wife divorce the house ownership confirmation, the demolition resettlement house and the small property right house in the divorce time housing property right confirmation practice concrete operation. Relocation housing and small property in the housing system still occupies a very large proportion. Because the property right of these houses is not clear or no property right at all, the form of property right is complex, so it is difficult to confirm the property right of divorced house. This article only from the point of view of practical operation, a brief introduction of these two cases.
