【摘要】：中國(guó)兩千年的封建社會(huì)中,在傳統(tǒng)小農(nóng)經(jīng)濟(jì)的基礎(chǔ)上形成了以男權(quán)為中心的封建婚姻制度,對(duì)中國(guó)古代社會(huì)乃至現(xiàn)代社會(huì)產(chǎn)生深遠(yuǎn)的影響。但從鴉片戰(zhàn)爭(zhēng)以來,西方一些先進(jìn)思想(特別是提倡婚姻自由、婦女解放、男女平等等思想)的傳入,給傳統(tǒng)婚姻制度注入新的血液,促使舊的婚姻制度的改革。中國(guó)共產(chǎn)黨在領(lǐng)導(dǎo)抗日戰(zhàn)爭(zhēng)和解放戰(zhàn)爭(zhēng)期間亦對(duì)舊婚姻制度進(jìn)行改革,但當(dāng)時(shí)的主要任務(wù)是抗日,婚姻法制建設(shè)也需要服從這個(gè)大局,一旦婚姻制度的建設(shè)影響了抗日的整體利益,根據(jù)地政府也不得不在政策、方式、力度等方面做出調(diào)整,因此這也是抗戰(zhàn)這一特定背景下婚姻建設(shè)的一個(gè)特點(diǎn)。 山東解放區(qū)作為我黨主要的革命根據(jù)地之一,對(duì)其婚姻立法進(jìn)行研究意義重大,這即可以體現(xiàn)我黨早期婚姻制度建設(shè)的偉大成就,也可以通過山東解放區(qū)婚姻制度的研究來探索新民主主義革命時(shí)期我黨婚姻立法的一些規(guī)律,并且豐富山東地方史的研究,同時(shí)展現(xiàn)山東人民革命的積極性和徹底性。本文運(yùn)用馬克思主義歷史唯物主義的觀點(diǎn)采用文獻(xiàn)法、歷史法、分析法、歸納法等研究方法,在已有研究的基礎(chǔ)上,依據(jù)大量的史料通過對(duì)山東解放區(qū)的婚姻法律制度的主要內(nèi)容與制度特點(diǎn)進(jìn)行研究,分析它的貫徹與實(shí)施的原因,并進(jìn)步分析山東解放區(qū)婚姻法制的歷史地位及其局限性。特別是通過對(duì)山東膠東地區(qū)婚姻法制的建設(shè)特殊性的研究,來體現(xiàn)我黨在制定政策時(shí)的實(shí)事求是精神、具體問題具體分析的精神。本文正文從四個(gè)方面展開論述。 第一部分“山東解放區(qū)婚姻法制的歷史淵源”分別從中國(guó)傳統(tǒng)婚姻法制、中國(guó)近代婚姻法制和中央根據(jù)地婚姻法制三個(gè)階段考察山東解放區(qū)進(jìn)行婚姻法制建設(shè)的依據(jù)。 第二部分“山東解放區(qū)婚姻法制建設(shè)的內(nèi)容”,主要從山東解放區(qū)的婚姻立法的概況、原則、結(jié)婚與離婚的規(guī)定和對(duì)軍婚的保護(hù)以及膠東地區(qū)對(duì)婚姻制度的特殊規(guī)定進(jìn)行分析。 第三部分“山東解放區(qū)婚姻法制建設(shè)的動(dòng)力”,利用大量的史料、實(shí)例等,分別從經(jīng)濟(jì)、政治、思想文化三個(gè)方面的原因,探究了山東解放區(qū)婚姻法制的建立與實(shí)施的動(dòng)力。 第四部分“山東解放區(qū)婚姻法制建設(shè)的歷史意義和局限性”分析了山東解放區(qū)婚姻法制在山東婦女解放和山東抗日戰(zhàn)爭(zhēng)及解放戰(zhàn)爭(zhēng)中所起的巨大作用及其局限性。
[Abstract]:In the feudal society of two thousand years, the feudal marriage system centered on male power was formed on the basis of the traditional small-scale peasant economy, which had a profound influence on the ancient Chinese society and even the modern society. However, since the Opium War, the introduction of some advanced ideas in the West (especially advocating the freedom of marriage, the emancipation of women, the equality of men and women) has injected new blood into the traditional marriage system and promoted the reform of the old marriage system. The Communist Party of China also reformed the old marriage system during the War of Resistance against Japan and the War of Liberation, but the main task at that time was to resist Japan, and the construction of the marriage legal system also needed to be guided by this overall situation. Once the construction of marriage system affected the overall interests of anti-Japanese, the government in the base area had to adjust its policies, methods and dynamics, so it was also a characteristic of marriage construction under the specific background of the War of Resistance against Japan. As one of the main revolutionary base areas of our Party, it is of great significance to study the marriage legislation in Shandong liberated areas, which can reflect the great achievements of our party's early marriage system construction. Through the study of marriage system in the liberated areas of Shandong Province, we can also explore some laws of our Party's marriage legislation in the period of the New Democratic Revolution, enrich the study of the local history of Shandong, and show the enthusiasm and thoroughness of the people's revolution in Shandong at the same time. This paper applies Marxist historical materialism to the research methods of literature method, historical method, analysis method, induction method, and so on, on the basis of the existing research. Based on a large number of historical data, this paper studies the main contents and institutional characteristics of the marriage legal system in the liberated areas of Shandong Province, analyzes the reasons for its implementation and implementation, and advances and analyzes the historical status and limitations of the marriage legal system in the liberated areas of Shandong Province. Especially through the study of the particularity of the construction of marriage law system in Shandong Jiaodong area, the spirit of seeking truth from facts and concrete analysis of concrete problems in formulating policies of our Party is embodied. The text of this paper is discussed from four aspects. The first part "the historical origin of marriage legal system in Shandong liberated area" examines the basis of marriage legal system construction in Shandong liberated area from three stages: Chinese traditional marriage legal system, Chinese modern marriage law system and central base area marriage legal system. The second part, "the content of marriage legal system construction in Shandong liberated area", mainly analyzes the general situation, principle, marriage and divorce regulation of marriage legislation and the protection of military marriage in Shandong liberated area, as well as the special provisions of marriage system in Jiaodong area. The third part, "the motive force of marriage legal system construction in Shandong liberated area", explores the motive force of the establishment and implementation of marriage legal system in Shandong liberated area from three aspects of economic, political, ideological and cultural reasons, using a large number of historical data, examples and so on. The fourth part, "the historical significance and limitation of marriage law construction in Shandong liberated areas", analyzes the great function and limitation of marriage law system in Shandong women's liberation, Shandong anti-Japanese war and liberation war.
