【摘要】:善意取得制度是民法的一項(xiàng)基本制度,它所涉及的深層次理論問(wèn)題是,所有權(quán)安全和交易安全的權(quán)衡問(wèn)題。在早期的民事立法中善意取得制度僅保護(hù)動(dòng)產(chǎn),而未涉及不動(dòng)產(chǎn),但隨著不動(dòng)產(chǎn)物權(quán)交易的日漸繁盛,以及不動(dòng)產(chǎn)登記免不了發(fā)生錯(cuò)誤和遺漏的情形,若不保護(hù)善意信賴登記薄的人,則不利于社會(huì)經(jīng)濟(jì)秩序的穩(wěn)定。鑒十此,我國(guó)《物權(quán)法》將善意取得制度統(tǒng)一適用于動(dòng)產(chǎn)和不動(dòng)產(chǎn)。由于面對(duì)著市場(chǎng)經(jīng)濟(jì)紛繁的利益紛爭(zhēng),以及平衡物的靜的安全與動(dòng)的安全的激烈沖突,傳統(tǒng)的民法理論并沒(méi)有充分的準(zhǔn)備,導(dǎo)致在現(xiàn)實(shí)生活中出現(xiàn)的很多實(shí)際問(wèn)題無(wú)法得到切實(shí)的解決;诖,本文將結(jié)合《物權(quán)法司法解釋(一)》,試圖通過(guò)對(duì)不動(dòng)產(chǎn)善意取得制度背后蘊(yùn)含的價(jià)值追尋和多元的價(jià)值衡量來(lái)探究該制度在實(shí)踐中的具體適用,即在公正的價(jià)值取向引導(dǎo)下選擇利益分配紛爭(zhēng)時(shí)的解決方案。本文共分為五個(gè)部分,主要內(nèi)容如下:第一部分主要從理論層面對(duì)善意取得制度進(jìn)行闡述。內(nèi)容諸如其概念、設(shè)立目的、法律后果、價(jià)值和功能等方面的內(nèi)容;第二部分通過(guò)比較分析國(guó)外關(guān)于不動(dòng)產(chǎn)善意取得制度的立法例,來(lái)論述將不動(dòng)產(chǎn)引入到善意取得制度中的歷程,其中主要是針對(duì)發(fā)達(dá)國(guó)家在此方面的先進(jìn)做法,從而概述和總結(jié)出確立該制度的基礎(chǔ)和必要性,并分析適用該制度的法律后果;第三部分主要以我國(guó)《物權(quán)法》頒布前后為背景分析我國(guó)確立不動(dòng)產(chǎn)善意取得制度的歷程,結(jié)合新頒布的《物權(quán)法司法解釋(一)》來(lái)論述我國(guó)不動(dòng)產(chǎn)善意取得制度的構(gòu)成要件,證實(shí)不論是在理論層面還是在實(shí)踐中我國(guó)都亟需確立不動(dòng)產(chǎn)善意取得制度;第四部分以我國(guó)《物權(quán)法》第106條以及《物權(quán)法司法解釋(一)》為基礎(chǔ)分析我國(guó)不動(dòng)產(chǎn)善意取得制度在立法上和實(shí)踐中存在的主要問(wèn)題;第五部分在對(duì)國(guó)外不動(dòng)產(chǎn)善意取得制度先進(jìn)立法例分析的基礎(chǔ)上,從立法層面、制度設(shè)計(jì)上對(duì)我國(guó)不動(dòng)產(chǎn)善意取得制度進(jìn)行粗淺探討,提出具體的立法建議和措施來(lái)完善該制度。
[Abstract]:The system of bona fide acquisition is a basic system of civil law. The deep theoretical problem involved in it is the trade-off between the security of ownership and the security of transaction. In the early civil legislation, the system of bona fide acquisition only protected movable property, but not real property, but with the flourishing of real property transactions, and the registration of real estate inevitably occurred errors and omissions. If you do not protect the good faith register, it is not conducive to the stability of social and economic order. In view of this, China's Real right Law applies bona fide acquisition system to movable and immovable property. In the face of the numerous conflicts of interests in the market economy, as well as the fierce conflict between the static security of balanced objects and the safety of moving objects, the traditional theory of civil law is not sufficiently prepared. As a result, many practical problems in real life can not be solved. Based on this, this paper will combine the Judicial interpretation of Real right Law (1), try to explore the practical application of the system through the pursuit of value and multiple value measurement behind the system of bona fide acquisition of real estate. That is, under the guidance of fair value orientation, the solution of interest distribution disputes. This paper is divided into five parts, the main contents are as follows: the first part mainly from the theoretical level to elaborate the system of bona fide acquisition. Content such as its concept, purpose of establishment, legal consequences, value and function. The second part through comparative analysis of foreign legislation on the system of acquisition of real estate in good faith, This paper discusses the process of introducing immovable property into bona fide acquisition system, which is mainly aimed at the advanced practices of developed countries in this respect, so as to summarize the foundation and necessity of establishing the system, and analyze the legal consequences of applying the system. The third part mainly analyzes the course of establishing the bona fide acquisition system of real estate in our country before and after the promulgation of the Real right Law, and discusses the constitutive elements of the bona fide acquisition system of real estate in our country in combination with the newly promulgated Judicial interpretation of the Real right Law (1). It is proved that it is urgent to establish the system of bona fide acquisition of real estate in China both in theory and in practice. The fourth part analyzes the main problems in legislation and practice of bona fide acquisition of immovable property system based on Article 106 of Real right Law and Judicial interpretation of Real right Law (1). In the fifth part, on the basis of analyzing the advanced legislation examples of foreign real estate bona fide acquisition system, from the legislative level, the system design of China's real estate bona fide acquisition system is discussed. Put forward specific legislative suggestions and measures to improve the system.
