【摘要】： 新中國(guó)建立后我國(guó)立法機(jī)構(gòu)先后頒布了三部婚姻法,逐漸形成了我國(guó)目前的夫妻財(cái)產(chǎn)制度體系。這一制度彰顯了男女平等、意思自治、保護(hù)弱者等人權(quán)理念,并對(duì)夫妻間財(cái)產(chǎn)的歸屬、分割、補(bǔ)償?shù)葍?nèi)容進(jìn)行了詳細(xì)的規(guī)定。中國(guó)歷史中重夫權(quán)而無(wú)視婦女財(cái)產(chǎn)權(quán)利的律法已經(jīng)被現(xiàn)代夫妻財(cái)產(chǎn)制度徹底取代,并在司法實(shí)踐中起到保護(hù)夫妻雙方利益、維護(hù)市場(chǎng)交易安全、促進(jìn)社會(huì)和諧穩(wěn)定發(fā)展的積極作用。 但是,隨著我國(guó)改革開(kāi)放和市場(chǎng)經(jīng)濟(jì)的繁榮,也帶來(lái)了一些新情況和新問(wèn)題的出現(xiàn),現(xiàn)行夫妻財(cái)產(chǎn)制度體系上的不完善、沒(méi)有一般通則性規(guī)定的指導(dǎo)、內(nèi)容與實(shí)際出現(xiàn)斷層和真空等問(wèn)題對(duì)司法實(shí)踐的影響不容低估。可是我國(guó)的立法機(jī)構(gòu)在對(duì)夫妻財(cái)產(chǎn)制度體系和一般通則性規(guī)定的尚不健全、內(nèi)容有待完善等一系列新的法律問(wèn)題,并沒(méi)有具體的立法措施。 本文針對(duì)上述問(wèn)題,具體探究了我國(guó)夫妻財(cái)產(chǎn)制度的歷史沿革和現(xiàn)狀,對(duì)我國(guó)夫妻財(cái)產(chǎn)制度的發(fā)展做一個(gè)全面的介紹,從而從法律淵源和現(xiàn)實(shí)特點(diǎn)分析我國(guó)夫妻財(cái)產(chǎn)制度的缺陷并提出具體的完善意見(jiàn)。本文通過(guò)借鑒其他發(fā)達(dá)大陸法系國(guó)家的相關(guān)立法,并結(jié)合當(dāng)前我國(guó)夫妻財(cái)產(chǎn)制度的特點(diǎn)和反應(yīng)出的新問(wèn)題,尋求完善我國(guó)夫妻財(cái)產(chǎn)制度切實(shí)可行的方法,由此得出,通過(guò)在體系上增設(shè)非常法定夫妻財(cái)產(chǎn)制,建立夫妻財(cái)產(chǎn)制度的一般通則性規(guī)定,以及夫妻法定財(cái)產(chǎn)制、約定財(cái)產(chǎn)制、個(gè)人特有財(cái)產(chǎn)制內(nèi)容上的增補(bǔ),解決當(dāng)前夫妻財(cái)產(chǎn)關(guān)系中新出現(xiàn)的法律真空和斷層問(wèn)題,從而使我國(guó)夫妻財(cái)產(chǎn)制度在新的社會(huì)條件下能夠更好的發(fā)揮規(guī)范夫妻財(cái)產(chǎn)關(guān)系的作用,并對(duì)司法審判實(shí)踐起到積極的指導(dǎo)作用。
[Abstract]:After the establishment of New China, the legislature of our country promulgated three marriage laws one after another, and gradually formed the current marital property system in our country.This system demonstrates the concept of equality between men and women, autonomy of will, protection of the weak and so on. It also makes detailed provisions on the ownership, division and compensation of property between husband and wife.In Chinese history, the law of attaching importance to husband power and ignoring women's property rights has been completely replaced by modern matrimonial property system, and has played a role in protecting the interests of husband and wife in judicial practice and safeguarding the security of market transactions.The positive role of promoting the harmonious and stable development of society.However, with the prosperity of China's reform and opening up and market economy, some new situations and problems have emerged, and the current marital property system is not perfect, without the guidance of general rules.The influence of fault and vacuum on judicial practice should not be underestimated.But the legislature of our country has no concrete legislative measures on a series of new legal problems, such as the system of husband and wife property system and the general rules and regulations, and the contents of which need to be perfected.In view of the above problems, this paper probes into the historical evolution and present situation of the marital property system in China, and makes a comprehensive introduction to the development of the marital property system in China.From the source of law and the characteristics of reality, this paper analyzes the defects of the property system of husband and wife in China and puts forward some concrete suggestions.By referring to the relevant legislation of other developed civil law countries and combining the characteristics and new problems of the current marital property system in our country, this paper seeks to perfect the practical methods of the marital property system in China, and draws a conclusion from this.Through the addition of extraordinary legal matrimonial property system in the system, the establishment of the general principles of the marital property system, as well as the addition of the content of the marital legal property system, the agreed property system, and the content of the personal property system,To solve the new legal vacuum and fault in the current marital property relationship, so that our country's marital property system can play a better role in regulating the marital property relationship under the new social conditions.And the practice of judicial trial plays a positive role in guidance.
