摘要：

《婚姻法》具有弱者保護(hù)功能,是保護(hù)殘疾人婚姻家庭權(quán)益的法理依據(jù)之所在.保護(hù)殘疾人權(quán)益體現(xiàn)了婚姻家庭的功能,符合《婚姻法》的特點(diǎn)和立法目的,體現(xiàn)公平和正義.我國對殘疾人婚姻家庭權(quán)益的保護(hù)制度,屬于立法空白,為切實(shí)保護(hù)殘疾人婚姻家庭權(quán)益,促進(jìn)家庭和諧和穩(wěn)定,建議《婚姻法》應(yīng)當(dāng)從總則和分則兩個(gè)方面增設(shè)殘疾人權(quán)益保護(hù)制度.

Abstract： 

Marriage law has the function of protecting the disadvantaged in marriage and family. Therefore, it’s the legal principle and baseline to protect rights and interests of the disabled in marriage and family. Protecting the disabled reflects the nature of marriage and family;it also complies with the law characteristics and principles of justice and fairness. However, this has not been added into China’s legal system yet. In order to actually project the disabled people’s rights and interests in family life, to enhance the family harmony and stability, the future marriage law should add the related articles into general profile and sub profiles.
