【摘要】：在女性勞動(dòng)權(quán)益救濟(jì)領(lǐng)域,其主要難題是社會(huì)排擠。對(duì)女性勞動(dòng)權(quán)益的社會(huì)排擠,不僅表現(xiàn)為性別歧視,而且也表現(xiàn)為基于性別歧視而引發(fā)的戶籍歧視、行業(yè)歧視、年齡、容貌和身高歧視以及婚姻和懷孕歧視。上述歧視的發(fā)生,漠視和剝奪了女性的勞動(dòng)權(quán)益,導(dǎo)致女性勞動(dòng)權(quán)益保障的弱化。對(duì)女性勞動(dòng)權(quán)益予以法律救濟(jì),就是要消除一切形式的性別歧視和社會(huì)排擠,確保女性享有與男性平等的勞動(dòng)權(quán)和其他基本人權(quán),使男女兩性從形式平等走向?qū)嵸|(zhì)平等。救濟(jì)女性勞動(dòng)權(quán)益的法律路徑,在于厘定法律救濟(jì)的觀念基礎(chǔ)和法律救濟(jì)的制度架構(gòu),為女性勞動(dòng)權(quán)益的切實(shí)保障奠定觀念基礎(chǔ)和制度基礎(chǔ)。
[Abstract]:In the field of women's labor rights and interests relief, its main problem is social exclusion. The social exclusion of women's labor rights and interests is manifested not only in gender discrimination, but also in household registration discrimination, industry discrimination, and age caused by gender-based discrimination. Discrimination in appearance and height, as well as discrimination in marriage and pregnancy. The above discrimination ignores and deprives women of their labor rights and interests, leading to the weakening of the protection of women's labour rights and interests. That is, to eliminate all forms of gender discrimination and social exclusion, to ensure that women enjoy equal labour rights and other basic human rights with men, and to move men and women from formal equality to substantive equality. It is to determine the conceptual basis of legal relief and the institutional framework of legal remedy, and to lay the conceptual and institutional basis for the practical protection of women's labor rights and interests.
