【摘要】：我國(guó)子女撫養(yǎng)費(fèi)制度遠(yuǎn)遠(yuǎn)不能有力地保護(hù)未成年人身心的健康成長(zhǎng)。本文先試圖對(duì)子女撫養(yǎng)費(fèi)的概念進(jìn)行澄清,再簡(jiǎn)介我國(guó)現(xiàn)行子女撫養(yǎng)費(fèi)制度,進(jìn)而分析我國(guó)現(xiàn)行子女撫養(yǎng)費(fèi)制度的缺陷與不足之處,最后對(duì)我國(guó)的子女撫養(yǎng)制度的完善提出建議與展望。本文基本內(nèi)容如下： 第一章是子女撫養(yǎng)費(fèi)的概述。包括子女撫養(yǎng)費(fèi)的概念,法律基礎(chǔ)進(jìn)行分析,特征,作用,新中國(guó)成立后的立法概況及其變遷。 第二章介紹我國(guó)現(xiàn)行子女撫養(yǎng)費(fèi)的一些具體制度。該章主要包括四節(jié)內(nèi)容：子女撫養(yǎng)費(fèi)權(quán)利義務(wù)主體,子女撫養(yǎng)費(fèi)的數(shù)額確定模式,子女撫養(yǎng)費(fèi)變更,子女撫養(yǎng)費(fèi)的給付與強(qiáng)制執(zhí)行制度。 第三章分析我國(guó)現(xiàn)行子女撫養(yǎng)費(fèi)制度的缺陷與不足。我國(guó)現(xiàn)行子女撫養(yǎng)費(fèi)制度的缺陷及不足之處主要表現(xiàn)在七個(gè)方面。 第四章是我國(guó)子女撫養(yǎng)費(fèi)制度的完善建議。在第三章對(duì)我國(guó)子女撫養(yǎng)費(fèi)制度存在的缺陷進(jìn)行分析以后,筆者試圖在本章對(duì)以上各缺陷提出完善建議。 最后,對(duì)子女撫養(yǎng)費(fèi)制度做出總結(jié),并對(duì)我國(guó)立法提出展望。
[Abstract]:China's child support system is far from being able to protect the healthy growth of minors. This paper attempts to clarify the concept of child support, and then introduces the current child support system in China. Then it analyzes the defects and deficiencies of the current child support system in China, and finally puts forward some suggestions and prospects for the improvement of the child support system in China. The basic contents of this paper are as follows:. The first chapter is an overview of child support, including the concept of child support, legal basis for analysis, characteristics, role, after the founding of new China legislative overview and changes. The second chapter introduces some specific systems of child support in our country. This chapter mainly includes four sections: the subject of child maintenance rights and obligations, the model of determining the amount of child support, the change of child support. The system of payment and enforcement of child support. The third chapter analyzes the defects and deficiencies of the current child support system in our country. The defects and deficiencies of the current child support system in China are mainly reflected in seven aspects. Chapter 4th is the suggestion to perfect the system of child support in our country. After analyzing the defects of the system of child support in the third chapter, the author tries to put forward some suggestions for the improvement of the above defects in this chapter. Finally, the child maintenance system is summarized, and the prospect of our legislation is put forward.
