【摘要】：對于中國的同性伴侶而言,相關(guān)法律的缺失和相關(guān)問題的出現(xiàn),這兩者的矛盾正在逐漸顯現(xiàn)。國內(nèi)對同性伴侶權(quán)益的保護(hù)的學(xué)界研究也極度貧乏。與之相對的是,國外的同性伴侶權(quán)益保護(hù)法律進(jìn)程卻在逐漸展開,有的已經(jīng)形成法律規(guī)范,有的也已經(jīng)提上了立法日程,其范圍遍及五大洲。本文試圖通過對他國同性伴侶權(quán)益保護(hù)的模式研究,深入把握西方對人權(quán)、平等的理解和這些概念的實(shí)質(zhì),并且為未來中國的同性伴侶權(quán)益保護(hù)立法問題搜集資料,更新理念,也希望對現(xiàn)今中國的婚姻家庭法有所貢獻(xiàn)。 同性伴侶權(quán)益保護(hù)這一訴求的出現(xiàn),引發(fā)了諸多關(guān)于其必要性的討論,有學(xué)者從法理學(xué)、法經(jīng)濟(jì)學(xué)、法社會學(xué)等角度認(rèn)同其相關(guān)價(jià)值所在,也有學(xué)者從倫理、婚姻本質(zhì)、未成年人的教育等方面質(zhì)疑其合理性。目前,存在同性伴侶權(quán)益保護(hù)制度的國家根據(jù)國情、社會意識等的不同,分別采取不同的模式對同性伴侶權(quán)益保護(hù)進(jìn)行實(shí)踐,總結(jié)下來包括拋開身份單純進(jìn)行個別規(guī)制的非婚同居模式,創(chuàng)設(shè)婚姻之外的第二種關(guān)系保護(hù)同性伴侶權(quán)益不與婚姻等同的中間模式,以及直接適用現(xiàn)有民法或婚姻家庭法的婚姻模式。三種模式存在不同的社會背景,受社會集體意識的制約程度不同,立法技術(shù)和主要內(nèi)容上也是有所差異。而中國目前相關(guān)立法的空白和問題開始出現(xiàn)的現(xiàn)實(shí)存在著一定的矛盾。當(dāng)未來中國可能需要對同性伴侶權(quán)益進(jìn)行保護(hù)時,這些實(shí)踐模式的借鑒作用是不可忽視的。我們可以從中得到先進(jìn)的理論和豐富的實(shí)踐經(jīng)驗(yàn),從而科學(xué)地得出未來中國關(guān)于同性伴侶權(quán)益保護(hù)的模式構(gòu)建的具體內(nèi)容。 筆者希望通過對國外關(guān)于同性伴侶權(quán)益保護(hù)的法律、學(xué)術(shù)資料進(jìn)行搜集整理,分析整合出條理清晰、趨勢鮮明的發(fā)展過程,從比較法的角度分析這些在同性伴侶權(quán)益保護(hù)立法方面比較成熟的國家的相關(guān)法律和學(xué)術(shù)資料,從理論上探討同性伴侶權(quán)益保護(hù)的適用條件和要求。當(dāng)中國發(fā)展到需要尋求同性伴侶權(quán)益保護(hù)的時代,本文能夠?yàn)槠涮峁┮恍┩暾摹⑾到y(tǒng)的資料,有利于理解這種制度的歷史發(fā)展進(jìn)程。
[Abstract]:For same-sex couples in China, the lack of relevant laws and the emergence of related problems, the contradiction between the two is gradually emerging. Domestic academic research on the protection of the rights and interests of same-sex couples is also extremely poor. However, the legal process of protecting the rights and interests of same-sex couples abroad is gradually unfolding. Some of them have already formed legal norms and some have put them on the legislative agenda. It covers five continents. This paper attempts to understand the western understanding of human rights, equality and the essence of these concepts by studying the model of protecting the rights and interests of same-sex couples in other countries. We also hope to contribute to the marriage and family law in China by collecting data and updating ideas for the future legislation on the protection of the rights and interests of same-sex couples in China. The emergence of the demand for the protection of the rights and interests of same-sex couples has led to a lot of discussions on its necessity. Some scholars identify with its relevant values from the perspectives of jurisprudence, law and economics, and sociology of law, and some scholars agree on the nature of marriage from the point of view of ethics, marriage, and so on. At present, countries that have a system of protecting the rights and interests of same-sex couples, depending on their national conditions and social consciousness, adopt different models to practice the protection of the rights and interests of same-sex couples. The conclusion includes setting aside the non-marital cohabitation mode of individual regulation and creating a second kind of intermediate model to protect the rights and interests of same-sex couples from marriage. And the marriage mode which directly applies to the existing civil law or marriage and family law. The three models have different social backgrounds and are restricted by the social collective consciousness. There are also differences in legislative techniques and main contents. However, there are some contradictions between the gaps in relevant legislation in China and the reality that problems are beginning to arise. When China may need to protect the rights and interests of same-sex couples in the future, We can get advanced theory and rich practical experience from which we can get the concrete contents of the model construction about the protection of the rights and interests of same-sex couples in China in the future. The author hopes to collect and sort out the foreign laws and academic materials on the protection of the rights and interests of same-sex couples, and to analyze and integrate the development process with a clear and clear trend. From the perspective of comparative law, this paper analyzes the relevant legal and academic data of these countries, which are relatively mature in legislation on the protection of the rights and interests of same-sex couples. This paper theoretically discusses the applicable conditions and requirements for the protection of the rights and interests of same-sex couples. When China has reached an era when it is necessary to seek the protection of the rights and interests of same-sex couples, this paper can provide it with some complete and systematic information. It is helpful to understand the historical development of this system.
