【摘要】：當今社會對于婦女財產(chǎn)權(quán)益的尊重與保護，是人們普遍關注的熱點話題。婦女財產(chǎn)權(quán)益受侵害的現(xiàn)象不僅影響了社會穩(wěn)定問題，侵害本身也是對法治精神的背離。我們只有理性認識并正確對待它，才能更好的健全和完善我國婦女財產(chǎn)權(quán)益的法律保護問題，以維護中國婦女財產(chǎn)權(quán)益和社會穩(wěn)定及和諧社會的構(gòu)建及“十二五”規(guī)劃的順利實現(xiàn)。傳統(tǒng)歷史習慣和社會偏見的原因和婦女財產(chǎn)權(quán)益立法、司法、執(zhí)法保護方面的原因?qū)е挛覈鴭D女財產(chǎn)權(quán)益保護的法律規(guī)定存在空白，缺乏科學體系；法律指導觀念落后，立法脫離國情；法律規(guī)定相對滯后于時代的發(fā)展；法律責任規(guī)定模糊法律過于原則化，缺乏可操作性等。本文試圖從立法、司法和執(zhí)法等角度入手提出解決我國婦女財產(chǎn)權(quán)益法律保護問題的建議是：深化研究，提供理論支持，借鑒國外先進經(jīng)驗，總結(jié)港澳臺優(yōu)秀實踐，健全完善我國婦女財產(chǎn)權(quán)益保護理論；完善立法，關注立法觀念、立法內(nèi)容和立法技術(shù)方面的必設性和全面性；加強司法，加強憲法司法化理念，強化程序觀念，理順司法程序，，加大司法解釋適應性的擴大及體系的清理，加大法官的自由裁量權(quán)，強化司法救濟做到法律效果和社會效果的統(tǒng)一；嚴格執(zhí)法，解決婦女財產(chǎn)權(quán)益保護中的重點和難點。
[Abstract]:The respect and protection of women's property rights and interests in today's society is a hot topic of general concern. The phenomenon that women's property rights and interests are infringed not only affects social stability, The violation itself is also a departure from the spirit of the rule of law. Only if we understand it rationally and deal with it correctly, can we better improve and perfect the legal protection of women's property rights and interests in our country. In order to safeguard the property rights and interests of Chinese women, the construction of a stable and harmonious society and the smooth realization of the 12th Five-Year Plan, the causes of traditional historical habits and social prejudices, and the legislation on women's property rights and interests, the administration of justice, The reasons for the protection of law enforcement lead to the absence of legal provisions for the protection of women's property rights and interests in China, the lack of scientific system, the backward concept of legal guidance, the separation of legislation from the national conditions, the relative lag of legal provisions in the development of the times; This paper tries to put forward some suggestions to solve the problem of the legal protection of women's property rights and interests from the angle of legislation, judicature and law enforcement, which are as follows: deepening the research, providing theoretical support, and so on. Draw lessons from foreign advanced experience, sum up the excellent practice of Hong Kong, Macao and Taiwan, perfect and perfect the theory of protecting the property rights and interests of women in our country, perfect the legislation, pay attention to the legislative concept, the content of legislation and the legislative technique, strengthen the judicature, Strengthening the concept of judicial constitution, strengthening the concept of procedure, straightening out the judicial procedure, enlarging the adaptability of judicial interpretation and cleaning up the system, increasing the discretion of judges, strengthening judicial relief to achieve the unity of legal effect and social effect; Strictly enforce the law and solve the key and difficult problems in protecting women's property rights and interests.
