【摘要】：2001年《婚姻法》修改案就夫妻財產(chǎn)約定有了較明確的約定,夫妻雙方當事人能夠自由的約定夫妻間的財產(chǎn),對于市場經(jīng)濟社會里個人自由化起了很重要的作用。但是在實務中,由于法律在這一塊規(guī)定仍然很模糊,比如夫妻約定財產(chǎn)的地位、舉證責任等制度,這樣就導致法官在解決現(xiàn)實中的問題時會遇到種種麻煩。本文以實例出發(fā),引出觀點,并且通過對該制度的相關(guān)理論進行探析。最后就我國在這方面規(guī)定的不足進行了分析,并且提出了筆者自己的立法完善建議,希望能取到一點現(xiàn)實效果。除引言外,本文分為四個部分,共約2萬字。 引言。本部分主要介紹此選題的理論意義和實踐價值;并介紹本選題的研究概況;和本選題的寫作特色。 第一部分案情介紹。本部分主要介紹了案件的由來、詳細的案情、當事人的訴訟請求和辯解理由以及法院的審理情況。 第二部分案件的主要爭議與分歧焦點。本部分主要介紹了雙方當事人對于案件的事實以及法律問題的爭議和分歧理由,并且由此引出本文所探討的具體問題。 第三部分婚姻財產(chǎn)制度的審視和解讀。本部分主要包括五個方面的內(nèi)容:一、夫妻婚姻財產(chǎn)約定制度的概述。本部分主要介紹夫妻財產(chǎn)約定制度的概念以及相關(guān)的構(gòu)成條件,并且談到該制度的性質(zhì)問題;二、夫妻約定財產(chǎn)制度的意義。本部分主要談到該制度在現(xiàn)如今市場經(jīng)濟社會中的現(xiàn)實意義,尤其是對夫妻雙方當事人對財產(chǎn)的處分的自由體現(xiàn)的作用;三、國外夫妻約定財產(chǎn)制的立法例。該部分主要介紹德國、法國、英國、美國在該制度的介紹。并且通過介紹進行了相關(guān)的比較;四、該部分主要介紹了我國目前對該制度的相關(guān)法律規(guī)定和司法解釋。并且進行了筆者的評論;五、我國現(xiàn)行夫妻約定財產(chǎn)制度的完善。該部分中先探討了我國在婚姻財產(chǎn)約定方面規(guī)定的不足,從夫妻約定財產(chǎn)制的內(nèi)容是否有明確規(guī)定,夫妻財產(chǎn)約定所應具備的實質(zhì)要件是否完備,夫妻財產(chǎn)約定的變更和撤銷的條件及程序是否完善,是否有公示制度,以便保護第三人的合法利益。之后筆者就這些問題提出了自己的一些立法建議。 第四部分結(jié)語。本部分是對全文的一個小結(jié),并且也提到了婚姻財產(chǎn)約定對未來社會的作用。
[Abstract]:In 2001, the Marriage Law was amended in the case of husband and wife property agreement has a more explicit agreement, husband and wife parties can freely agree on the property between husband and wife. It plays an important role in the individual liberalization in the market economy society. However, in practice, because of the law in this piece of provisions is still very vague, such as the marital agreed property status, burden of proof and other systems. In this way, the judge will encounter all kinds of problems in solving the problems in reality. This paper starts with an example, leading to the point of view. And through the analysis of the relevant theory of the system. Finally, the deficiencies of the provisions in this area are analyzed, and the author puts forward his own suggestions for legislative improvement. In addition to the introduction, this paper is divided into four parts, a total of about 20,000 words. Introduction. This part mainly introduces the theoretical significance and practical value of this topic; and introduces the research situation of this topic; and the writing characteristics of this topic. The first part is the introduction of the case. This part mainly introduces the origin of the case, the details of the case, the litigants' claims and justifications, as well as the trial of the court. The second part of the main dispute and the focus of the case. This part mainly introduces the parties to the facts of the case and the legal issues of the dispute and the reasons for disagreement. And this leads to the specific problems discussed in this paper. The third part examines and interprets the marital property system. This part mainly includes five aspects: 1. This part mainly introduces the concept of the marital property agreement system and the related conditions, and discusses the nature of the system; Second, the meaning of the husband and wife agreement property system. This part mainly talks about the practical significance of the system in the present market economy society, especially the role of the husband and wife parties in the free embodiment of the disposition of the property; Third, the legislative examples of foreign couples' agreed property system. This part mainly introduces the introduction of Germany, France, Britain and the United States in this system. Fourth, this part mainly introduces the relevant legal provisions and judicial interpretation of this system in our country at present, and carries on the author's comments; Fifth, the consummation of the current marital contract property system in our country. This part first discusses the deficiency of the marital property agreement in our country, and whether there is a clear stipulation in the content of the marital contract property system. Husband and wife property agreement should have the essential elements is complete, the marital property agreement changes and cancels the condition and the procedure is perfect, whether has the public notice system. In order to protect the legitimate interests of the third party, the author put forward some legislative suggestions on these issues. Part 4th conclusion. This part is a summary of the full text, and also mentioned the role of matrimonial property agreement on the future society.
