環(huán)境行政合同法律問(wèn)題研究

【摘要】: 現(xiàn)代社會(huì)是一個(gè)經(jīng)濟(jì)飛速發(fā)展的社會(huì),而隨著經(jīng)濟(jì)發(fā)展帶來(lái)的環(huán)境問(wèn)題也越來(lái)越多的受到人們的關(guān)注。一種新型的治理環(huán)境問(wèn)題的手段——環(huán)境行政合同走入人們的視野,即政府的環(huán)境保護(hù)職能部門與環(huán)境活動(dòng)主體以合同的方式約定雙方在有關(guān)環(huán)境保護(hù)活動(dòng)中的權(quán)利義務(wù),以實(shí)現(xiàn)環(huán)境保護(hù)的目的的一種改善環(huán)境的方法。這種方式在許多發(fā)達(dá)國(guó)家,如日本,荷蘭,德國(guó),法國(guó)等都得到了廣泛應(yīng)用并取得了很好的效果,這些都是值得我國(guó)借鑒的寶貴經(jīng)驗(yàn)。同時(shí),我國(guó)在環(huán)境行政合同方面的相關(guān)實(shí)踐也屢見不鮮。然而在實(shí)踐中出現(xiàn)的問(wèn)題也是不容忽視的。主要表現(xiàn)為權(quán)利義務(wù)設(shè)置不夠明確和平等;合同的履行過(guò)程中不注意對(duì)于行政相對(duì)人的保護(hù),造成相對(duì)人參與積極性低;部分行政相對(duì)人出于私利,不惜犧牲公共利益等。上述問(wèn)題限制了環(huán)境行政合同作為一個(gè)新型的的管理方法,在我國(guó)的環(huán)境治理領(lǐng)域發(fā)揮其應(yīng)有的作用。本文對(duì)環(huán)境行政合同概念進(jìn)行了介紹與剖析,介紹了一些發(fā)達(dá)國(guó)家的相關(guān)實(shí)踐,并結(jié)合了我國(guó)目前實(shí)踐中出現(xiàn)的問(wèn)題以及對(duì)其原因的分析,對(duì)于構(gòu)建我國(guó)環(huán)境行政合同制度提出了一些設(shè)想。 本文共分為四章: 第一章為環(huán)境行政合同的概念探析,旨在明確環(huán)境行政合同這一概念的內(nèi)涵,介紹了環(huán)境行政合同名稱、范疇、定義,并對(duì)其特征進(jìn)行總結(jié),包括其主體的特征,環(huán)境行政合同契約精神的有限性以及環(huán)境行政合同的公益性、科學(xué)性和長(zhǎng)期性。 第二章為發(fā)達(dá)國(guó)家的相關(guān)實(shí)踐及對(duì)我國(guó)的啟示,旨在通過(guò)對(duì)發(fā)達(dá)國(guó)家在環(huán)境行政合同方面的實(shí)踐總結(jié)出值得我國(guó)借鑒的寶貴經(jīng)驗(yàn)。本章首先介紹了日本、荷蘭、德國(guó)、法國(guó)的相關(guān)實(shí)踐,隨后對(duì)其經(jīng)驗(yàn)進(jìn)行了總結(jié)。 第三章為我國(guó)環(huán)境行政合同的現(xiàn)狀及存在問(wèn)題。本章主要介紹了環(huán)境行政合同在我國(guó)應(yīng)用的幾種主要形式:污染治理類行政合同,環(huán)境保護(hù)目標(biāo)責(zé)任書,環(huán)境工程建設(shè)合同,退耕還林合同,護(hù)林員委任合同,排污權(quán)許可合同等,結(jié)合實(shí)際例子逐一指出其存在的問(wèn)題,并對(duì)問(wèn)題成因進(jìn)行了分析。 第四章為關(guān)于構(gòu)建我國(guó)環(huán)境行政合同制度的一些設(shè)想。本章闡述了筆者關(guān)于構(gòu)建我國(guó)環(huán)境行政合同制度的相關(guān)設(shè)想,包括對(duì)基本原則的確定,環(huán)境行政內(nèi)容的設(shè)置,以及對(duì)于環(huán)境行政合同目的的實(shí)現(xiàn)有著重要意義違約責(zé)任和救濟(jì)制度。
[Abstract]:Modern society is a society with rapid economic development, and with the economic development, environmental problems are paid more and more attention. The environmental administrative contract is a new way to control the environmental problem, that is, the government's environmental protection function department and the environmental activity subject agree in the way of contract the rights and obligations of the two parties in the relevant environmental protection activities. A method of improving the environment for the purpose of environmental protection. This method has been widely used in many developed countries, such as Japan, Holland, Germany, France and so on. At the same time, our country in the environmental administrative contract related practice is also common. However, the problems in practice can not be ignored. The main performance of the right and obligation is not clear and equal; the performance of the contract does not pay attention to the protection of the administrative counterpart, resulting in low participation enthusiasm; some administrative counterpart out of private interests, at the expense of public interests. The above problems limit the environmental administrative contract as a new management method and play its due role in the field of environmental governance in China. This paper introduces and analyzes the concept of environmental administrative contract, introduces the relevant practices of some developed countries, and analyzes the problems and causes in our country's current practice. Some tentative ideas are put forward for the construction of environmental administrative contract system in China. This paper is divided into four chapters: the first chapter is the analysis of the concept of environmental administrative contract, aiming at clarifying the connotation of the concept of environmental administrative contract, introducing the name, category, definition of environmental administrative contract, and summarizing its characteristics. It includes the characteristics of the subject, the limitation of the contract spirit of the environmental administrative contract and the public welfare, scientific and long-term nature of the environmental administrative contract. The second chapter is about the relevant practices of developed countries and the enlightenment to our country, aiming at summing up the valuable experience of our country through the practice of environmental administrative contract in developed countries. This chapter first introduces the relevant practices of Japan, the Netherlands, Germany and France, and then summarizes their experiences. The third chapter is the current situation and existing problems of environmental administrative contract in China. This chapter mainly introduces several main forms of environmental administrative contract applied in our country: administrative contract of pollution control, environmental protection target responsibility, environmental engineering construction contract, contract of returning farmland to forest, contract of forest protection appointment, Combined with practical examples, the existing problems are pointed out, and the causes of the problems are analyzed. The fourth chapter is about the construction of China's environmental administrative contract system some ideas. This chapter describes the author's related ideas on the construction of environmental administrative contract system in China, including the determination of the basic principles, the setting of environmental administrative content, And the realization of environmental administrative contract has important significance of breach of contract liability and relief system.
