【摘要】：企業(yè)參與污染物排放標(biāo)準(zhǔn)的制定是提高標(biāo)準(zhǔn)實(shí)效性的手段,問(wèn)題在于怎樣的法律設(shè)置才能保障企業(yè)參與的權(quán)利同時(shí)規(guī)制企業(yè)的參與行為。文章首先論證得出法律保障企業(yè)參與的必要性,即通過(guò)立法保障企業(yè)的參與符合國(guó)內(nèi)外參與型行政理論;具有提高排放標(biāo)準(zhǔn)的制定效率、減少企業(yè)參與負(fù)面影響的現(xiàn)實(shí)必要性;同時(shí)有助于將標(biāo)準(zhǔn)行政主管部門(mén)與企業(yè)間的利益權(quán)衡前置,增強(qiáng)標(biāo)準(zhǔn)制定的針對(duì)性和可操作性。文章同時(shí)分析了實(shí)現(xiàn)企業(yè)有效參與對(duì)相關(guān)立法的應(yīng)然要求及我國(guó)現(xiàn)行法律規(guī)制不同程度的缺失;企業(yè)參與階段、征求意見(jiàn)的執(zhí)行、排放標(biāo)準(zhǔn)制定過(guò)程的監(jiān)督機(jī)制等方面存在的問(wèn)題,并最終提出以完善標(biāo)準(zhǔn)化法及相關(guān)管理辦法為途徑,充分保障企業(yè)的參與權(quán)利、程序性規(guī)制其參與行為、明確各參與主體的法律責(zé)任、完善司法救濟(jì)和配套制度等立法建議。
[Abstract]:Enterprise participation in the formulation of pollutant emission standards is a means to improve the effectiveness of the standards. The problem lies in how to set up laws to protect the right of enterprises to participate and to regulate the participation of enterprises. Firstly, the paper argues that it is necessary to guarantee the participation of enterprises by law, that is, to ensure the participation of enterprises conforms to the administrative theory of participation at home and abroad, to improve the efficiency of emission standards, and to reduce the negative impact of enterprise participation. At the same time, it is helpful to balance the benefits between the standard administrative department and the enterprise, and to enhance the pertinence and operability of the standard formulation. At the same time, the article analyzes the required requirements for effective participation of enterprises in relevant legislation and the absence of different degrees of existing legal regulations in our country, as well as the implementation of solicitation of opinions in the stage of enterprise participation. The problems existing in the monitoring mechanism of the emission standard formulation process, and finally put forward to perfect the standardization law and related management methods as a way to fully protect the participation rights of enterprises, procedural regulation of their participation behavior, Make clear the legal responsibility of the participants, perfect the judicial relief and supporting system and other legislative suggestions.
