【摘要】：《環(huán)境行政處罰辦法》于2009年12月30日修訂通過,并于2010年3月1日起施行,原國家環(huán)境保護總局1999年發(fā)布的《環(huán)境保護行政處罰辦法》同時廢止。從《環(huán)境保護行政處罰辦法》到《環(huán)境行政處罰辦法》,對環(huán)境行政處罰的規(guī)定走過了從對《行政處罰法》的亦步亦趨、簡單重復,到注重既與上位法、相關(guān)法規(guī)及司法解釋的銜接與協(xié)調(diào),又突出環(huán)境行政處罰工作的特色,是數(shù)十年來環(huán)境行政處罰實踐成果的集中體現(xiàn)。
[Abstract]:The measures on Administrative penalties for Environmental Protection was revised and adopted on December 30, 2009, and went into effect on March 1, 2010. The measures on Administrative penalties for Environmental Protection issued by the State Environmental Protection Administration in 1999 were abolished at the same time. From "measures of Administrative punishment for Environmental Protection" to "measures of Administrative punishment for Environmental Protection", the regulations on environmental administrative penalties have gone from following the steps of "Administrative punishment Law", simply repeating, to paying attention to both and superior laws, The connection and coordination of relevant laws and regulations and judicial interpretation, as well as the outstanding features of environmental administrative punishment, are the concentrated embodiment of the practical achievements of environmental administrative punishment in the past decades.
