【摘要】：我國危險(xiǎn)廢物污染環(huán)境事件的不斷發(fā)生使危險(xiǎn)廢物管理問題得到越來越多的關(guān)注。危險(xiǎn)廢物管理是一項(xiàng)由法規(guī)推動(dòng)的事業(yè),法律制度在危險(xiǎn)廢物管理中承擔(dān)了極重要的角色。我國危險(xiǎn)廢物管理法律制度雖已初步確立,但在實(shí)際運(yùn)用中暴露出諸多問題,需要有針對(duì)性地進(jìn)行危險(xiǎn)廢物管理法律制度的建構(gòu)與完善設(shè)計(jì),使之能更有效地推進(jìn)我國危險(xiǎn)廢物管理。 本文從危險(xiǎn)廢物管理的基本理論入手,界定和明晰了危險(xiǎn)廢物及危險(xiǎn)廢物管理的概念;通過對(duì)危險(xiǎn)廢物管理的理論基礎(chǔ)和理念的揭示,指出我國危險(xiǎn)廢物管理重預(yù)防、全過程、多層次管理的制度設(shè)計(jì)原則;梳理了包括危險(xiǎn)廢物的鑒別、收運(yùn)、處置等各項(xiàng)制度和相對(duì)應(yīng)的立法情況;結(jié)合危險(xiǎn)廢物管理實(shí)踐的信息反饋,指出危險(xiǎn)廢物管理法律制度中存在的鑒別制度操作難度大、處理收費(fèi)制度難執(zhí)行、代處置制度難應(yīng)用、交換制度缺位及善后處理制度不完善等具體問題及成因,并根據(jù)前述分析和國外可借鑒的思路做法提出相對(duì)應(yīng)的完善對(duì)策。 本文的創(chuàng)新之處在于,結(jié)合對(duì)危險(xiǎn)廢物管理思想演化和目標(biāo)多元化發(fā)展特點(diǎn)的描述,提出了危險(xiǎn)廢物管理的定義;通過對(duì)我國現(xiàn)有危險(xiǎn)廢物管理法律制度淵源及內(nèi)容的全面而整體的歸納,擺明了我國危險(xiǎn)廢物管理法律制度的框架和體系現(xiàn)狀;通過現(xiàn)實(shí)事例揭示了在棄置危險(xiǎn)廢物管理方面存在的法律缺位問題,并預(yù)見將來因危險(xiǎn)廢物處理處置機(jī)構(gòu)選址等問題而導(dǎo)致的公共決策事件數(shù)量的上升將不可避免,相應(yīng)的信息公開制度設(shè)計(jì)必須跟進(jìn)。
[Abstract]:The problem of hazardous waste management has been paid more and more attention due to the continuous occurrence of hazardous waste pollution in China. Hazardous waste management is a regulated enterprise, and the legal system plays an important role in the management of hazardous wastes. Although the legal system of hazardous waste management in our country has been preliminarily established, many problems have been exposed in the practical application, so it is necessary to construct and perfect the legal system of hazardous waste management. To enable it to more effectively promote the management of hazardous wastes in China. This paper starts with the basic theory of hazardous waste management, defines and clarifies the concept of hazardous waste and hazardous waste management, points out that the whole process of hazardous waste management in our country is to prevent the hazardous waste management. The system design principle of multi-level management; combing the system including the identification, collection and transportation of hazardous waste and the corresponding legislative situation; combining with the information feedback of hazardous waste management practice, It is pointed out that the identification system in the legal system of hazardous waste management is difficult to operate, the charging system is difficult to implement, the substitute disposal system is difficult to be applied, the exchange system is absent and the aftertreatment system is not perfect, and so on. And according to the above analysis and foreign ideas and practices can be used for reference to improve the corresponding countermeasures. The innovation of this paper is that the definition of hazardous waste management is put forward in combination with the description of the evolution of hazardous waste management thought and the characteristics of diversified development of the goal. By summing up the sources and contents of the existing legal system of hazardous waste management in China, it shows the framework and present situation of the legal system of hazardous waste management in China. Practical examples reveal the legal gaps in the management of the disposal of hazardous wastes and foresee an inevitable increase in the number of public decision-making events resulting from problems such as the location of hazardous waste disposal and disposal institutions in the future. The corresponding information disclosure system design must follow up.
