【摘要】：氣候變化背景下,我國面臨巨大的減排挑戰(zhàn),同時也面臨碳市場快速發(fā)展的歷史機遇。順應(yīng)節(jié)能減排領(lǐng)域?qū)μ冀灰资袌龌姆尚枨?發(fā)揮法律在碳交易市場創(chuàng)建、交易規(guī)則形成、市場規(guī)模擴張、交易平臺構(gòu)建、交易形式創(chuàng)新等方面的制度優(yōu)勢,是當前我國碳交易市場化進程中的基本途徑。同時也是充分利用我國巨大的減排潛力所形成的交易影響力,在國際碳交易市場化進程中發(fā)出"自己的聲音",發(fā)揮我國在低碳發(fā)展中"后發(fā)優(yōu)勢"的重要保障。因此,探討法律在碳交易市場化進程中對碳交易市場創(chuàng)造、交易技術(shù)保障、物質(zhì)保障、制度保障、交易平臺、碳權(quán)保護等市場化環(huán)節(jié)中的基礎(chǔ)性促導(dǎo)和保障作用,具有較強的理論價值和實踐意義。
[Abstract]:Against the background of climate change, China is faced with a huge challenge of emission reduction and a historical opportunity of rapid development of the carbon market. According to the legal demand of carbon trading in the field of energy saving and emission reduction, we should give full play to the institutional advantages of law in the establishment of carbon trading market, the formation of trading rules, the expansion of market scale, the construction of trading platforms, the innovation of trading forms, and so on. It is the basic way in the process of carbon trading marketization in our country at present. At the same time, it is also an important guarantee to make full use of the trading influence formed by our country's huge abatement potential, to give its own voice in the process of international carbon trading marketization, and to give full play to our country's "late-development advantage" in low-carbon development. Therefore, this paper probes into the fundamental role of law in the market creation, trade technology, material security, system protection, trading platform, carbon rights protection and other market-oriented links in the process of carbon trading marketization, such as the creation of carbon trading market, the trade technology guarantee, the material security, the system guarantee, the trading platform, the carbon right protection, etc. It has strong theoretical value and practical significance.
