【摘要】： 環(huán)境問題始終是當(dāng)今世界所關(guān)注的問題。以往人類為了大量追求經(jīng)濟(jì)效益的開發(fā)而忽視了自然環(huán)境和生態(tài)環(huán)境,對(duì)自然環(huán)境和生態(tài)環(huán)境造成了嚴(yán)重破壞,使人類自己嘗到了苦果。隨著自然環(huán)境的不斷惡化,人類對(duì)生活環(huán)境的不斷提高,對(duì)整潔、舒適的生活環(huán)境不斷的追求,對(duì)環(huán)境的重視程度也越來越強(qiáng)。特別是近幾年,環(huán)境問題已經(jīng)成為影響人類生存和發(fā)展的必要因素,全球?qū)τ诃h(huán)境管理的理念也發(fā)生了重大變化,要深入解決環(huán)境問題必須從經(jīng)濟(jì)方面著手；還要長遠(yuǎn)的考慮與人體生存有關(guān)的環(huán)境問題。 《中華人民共和國環(huán)境影響評(píng)價(jià)法》于2002年10月頒布并實(shí)施,表明具有中國特色的環(huán)境影響評(píng)價(jià)法律法規(guī)體系已經(jīng)初步建立。但隨著國家建設(shè)的宏偉事業(yè)大力的發(fā)展,這部法律已經(jīng)不足以適應(yīng)當(dāng)今的需要。在相繼七年后,由國務(wù)院簽發(fā)的《規(guī)劃環(huán)境影響評(píng)價(jià)條例》于2009年10月1日施行。條例對(duì)于規(guī)劃環(huán)境影響評(píng)價(jià)的內(nèi)容、依據(jù)及形式等方面進(jìn)行了規(guī)劃�！兑�(guī)劃環(huán)境影響評(píng)價(jià)條例》的實(shí)施是我國環(huán)境立法領(lǐng)域的重大進(jìn)步,標(biāo)志著環(huán)境保護(hù)參與綜合決策從此進(jìn)入新的發(fā)展領(lǐng)域。它的實(shí)施將有利于重塑政府的宏觀決策,推進(jìn)規(guī)劃環(huán)評(píng)早期介入規(guī)劃決策,強(qiáng)化規(guī)劃環(huán)評(píng)的執(zhí)行效力,真正的從源頭上防止環(huán)境污染和生態(tài)破壞,在決策前端把好環(huán)境關(guān)。 本文介紹了規(guī)劃環(huán)評(píng)的法律制度并對(duì)其進(jìn)行研究,指出了我國規(guī)劃環(huán)評(píng)法律制度的不足,并借鑒外國規(guī)劃環(huán)評(píng)法律制度的經(jīng)驗(yàn),理性的分析了我國規(guī)劃環(huán)評(píng)法律制度的現(xiàn)狀,通過比較,找出了適合我國的先進(jìn)規(guī)劃環(huán)評(píng)理念和方法,對(duì)此進(jìn)行科學(xué)有效的分析,從而指導(dǎo)我國規(guī)劃環(huán)評(píng)法律制度的發(fā)展,對(duì)于推動(dòng)規(guī)劃環(huán)評(píng)法律制度的工作開展,提高規(guī)劃環(huán)評(píng)的技術(shù)水平和管理水平都具有一定的指導(dǎo)意義。 我們力求在大力發(fā)展經(jīng)濟(jì)的過程中解決環(huán)境保護(hù)的問題,實(shí)現(xiàn)可持續(xù)發(fā)展的戰(zhàn)略,從而達(dá)到經(jīng)濟(jì)、環(huán)境、社會(huì)三者的協(xié)調(diào)發(fā)展。
[Abstract]:Environmental problems have always been the focus of attention in the world today. In the past, human beings ignored the natural environment and ecological environment in order to pursue economic benefits in a large amount, and caused serious damage to the natural environment and ecological environment, which made the mankind taste the bitter fruit. With the continuous deterioration of the natural environment, the continuous improvement of human living environment, the pursuit of clean and comfortable living environment, the degree of attention to the environment is becoming stronger and stronger. Especially in recent years, environmental problems have become an essential factor affecting the survival and development of human beings, and the concept of global environmental management has also undergone significant changes. In order to solve environmental problems in depth, we must start from the economic aspects; The Environmental impact Assessment Law of the people's Republic of China was promulgated and implemented in October 2002. It shows that the system of environmental impact assessment laws and regulations with Chinese characteristics has been preliminarily established. But with the great development of national construction, this law is not enough to meet the needs of today. Seven years later, the Planning Environmental impact Assessment regulations issued by the State Council came into effect on October 1, 2009. The regulations have planned the content, basis and form of planning environmental impact assessment. The implementation of the "Planning Environmental impact Assessment regulations" is a major progress in the field of environmental legislation in China. It marks the environmental protection participation in the comprehensive decision-making from now on into a new field of development. Its implementation will help to reshape the government's macro decision, promote the early intervention of planning environmental impact assessment, strengthen the effectiveness of the implementation of planning environmental impact assessment, truly prevent environmental pollution and ecological damage from the source, and control the environment at the front end of decision-making. This paper introduces and studies the legal system of planning environmental impact assessment, points out the shortcomings of the legal system of planning environmental impact assessment in China, and draws lessons from the experience of foreign countries, and rationally analyzes the present situation of the legal system of planning environmental impact assessment in China. Through comparison, this paper finds out the idea and method of advanced planning environmental impact assessment which is suitable for our country, and makes a scientific and effective analysis of it, so as to guide the development of our country's legal system of planning environmental impact assessment, and to promote the work of planning environmental impact assessment legal system. Improving the technical level and management level of EIA has certain guiding significance. We strive to solve the problem of environmental protection and realize the strategy of sustainable development in the course of vigorously developing economy, so as to achieve the coordinated development of economy, environment and society.
