【摘要】： 由于人們的環(huán)境保護意識的提高和政府對環(huán)境問題的重視,我國野生動物資源的狀況得到了很大的改善,野生動物的數(shù)量不斷增加,但是野生動物傷害人畜、破壞農(nóng)作物的事件也越來越多。人類與動物爭取資源和生存空間成為了現(xiàn)實生活中常見的事情,這無疑會使我們在保護野生動物方面產(chǎn)生困惑。野生狀態(tài)下的動物致人損害的,我國目前尚無立法明確規(guī)定如何對受害人進行救濟,使得大量相對人權益得不到保障。尤其是遭受野生動物侵害的事件大多發(fā)生在經(jīng)濟欠發(fā)達的省份或地區(qū),受到侵害的當事人往往陷入到一個十分窘迫的地步,因此研究野生動物致人損害的救濟是一個刻不容緩的話題。 野生動物的所有人是國家,那么由國家來承擔野生動物造成的人身財產(chǎn)損失是符合一般的法理價值衡量的,但具體應該采用什么樣的方式,并沒有相應的法律規(guī)定,在法律體系上是一個空白,探討野生動物致人損害的救濟是有著理論和現(xiàn)實意義的。 作者試圖在國家補償?shù)慕嵌?從野生動物致人損害的案件事實出發(fā),研究野生動物致人損害由國家進行補償?shù)姆ɡ砘A,國內(nèi)外研究狀況,對我國有關野生動物致人損害的補償理論和具體實踐中存在的問題進行闡述,在野生動物致人損害的國家補償制度方面提出一些解決的建議。
[Abstract]:Due to the improvement of people's environmental protection consciousness and the government's attention to environmental problems, the status of wildlife resources in China has been greatly improved, the number of wild animals has been increasing, but wild animals harm people and animals. More and more crops are being destroyed. Fighting for resources and living space between human beings and animals has become a common thing in real life, which undoubtedly confuses us in protecting wild animals. At present, there is no legislation on how to provide relief to the victims, which makes the rights and interests of a large number of relative persons unprotected. In particular, most of the incidents of wildlife abuse occur in economically underdeveloped provinces or regions, and the victims are often in a state of great embarrassment. Therefore, the study of wildlife damage relief is an urgent topic. The owner of wild animals is the state, so the state to bear the loss of life and property caused by wildlife is in line with the general legal value, but what kind of method should be adopted, and there are no corresponding legal provisions. It is a blank in the legal system. It is of theoretical and practical significance to probe into the remedy of damage caused by wild animals. From the angle of state compensation, the author tries to study the legal basis of compensation for human damage caused by wild animals, and the research situation at home and abroad, from the point of view of the case of wildlife damage to human beings. This paper expounds the problems existing in the theory and practice of compensation for human damage caused by wild animals in China, and puts forward some suggestions on the national compensation system for human damage caused by wild animals.
