【摘要】：國(guó)務(wù)院2009年12月31日發(fā)布了《國(guó)務(wù)院關(guān)于推進(jìn)海南國(guó)際旅游島建設(shè)發(fā)展的若干意見》對(duì)無居民島嶼做出了初步規(guī)劃意向。本文從海南所轄無居民島嶼使用權(quán)的登記問題研究出發(fā),在借鑒國(guó)外主流立法經(jīng)驗(yàn)的基礎(chǔ)上,結(jié)合我國(guó)和海南地區(qū)當(dāng)前的具體情況,深入分析海南周邊無居民島嶼利用與保護(hù)情況,根據(jù)我國(guó)現(xiàn)行法規(guī)有關(guān)規(guī)定,運(yùn)用經(jīng)濟(jì)法理論進(jìn)行分析,最終探討我國(guó)對(duì)海南周邊無居民島嶼利用與保護(hù)的法律框架構(gòu)建。具體包括以下內(nèi)容： 第一部分為無居民島嶼的基本理論分析。對(duì)無居民島嶼及其使用權(quán)的概念、特征進(jìn)行了認(rèn)證,并對(duì)無居民島嶼利用與保護(hù)的原則及制度安排予以論述。分析國(guó)內(nèi)外對(duì)無居民島嶼利用與保護(hù)原則基本情況及其利用與保護(hù)法律規(guī)制情況,并對(duì)其進(jìn)行了理論及法律評(píng)價(jià)。主要闡述當(dāng)今國(guó)外法律對(duì)使用及保護(hù)制度的規(guī)定,結(jié)合海南實(shí)際情況的比較、研究。 第二部分為海南無居民島嶼利用與保護(hù)法律制度分析。分析了目前海南無居民島嶼利用與保護(hù)基本情況及其立法情況,結(jié)合國(guó)外使用及保護(hù)制度的規(guī)定,對(duì)海南無居民島嶼利用與保護(hù)現(xiàn)狀進(jìn)行分析,指出海南針對(duì)無居民島嶼利用與保護(hù)中存在的主要問題。 第三部分為海南無居民島嶼利用與保護(hù)對(duì)策探討。主要針對(duì)第二部分探討得出的海南無居民島嶼利用與保護(hù)現(xiàn)狀中存在的問題,對(duì)登記制度、無居民島嶼使用權(quán)取得、流轉(zhuǎn)、抵押制度的完善、使用年限問題探討、海南無居民島嶼管理主體的厘定,適用前的環(huán)境影響評(píng)價(jià)制度、適用排污收費(fèi)制度、污染者付費(fèi)制度、完善無居民島嶼保護(hù)專項(xiàng)基金制度以及海南無居民島嶼開發(fā)利用中的糾紛解決機(jī)制的構(gòu)建等問題提出相應(yīng)的對(duì)策,主要從經(jīng)濟(jì)法理論的角度入手,結(jié)合海南實(shí)際情況,構(gòu)建一個(gè)綜合、有效的海南無居民島嶼利用與保護(hù)制度。
[Abstract]:On December 31, 2009, the State Council issued the opinions of the State Council on promoting the construction and development of Hainan's international tourist island. Based on the research on the registration of the right to use the non-inhabitant islands in Hainan, and on the basis of drawing lessons from the mainstream legislative experience of foreign countries, this paper combines the current situation of China and Hainan. Based on the analysis of the utilization and protection of the uninhabited islands around Hainan, this paper analyzes the utilization and protection of the uninhabited islands around Hainan by using the theory of economic law, and finally probes into the construction of the legal framework for the utilization and protection of the uninhabited islands around Hainan. It includes the following contents: the first part is the basic theory analysis of the non-inhabitant islands. The concept and characteristics of non-inhabitant islands and their right to use are verified, and the principles and institutional arrangements for the utilization and protection of non-inhabitant islands are discussed. This paper analyzes the basic situation of the principle of utilization and protection of uninhabited islands at home and abroad, and the legal regulation of its utilization and protection, and makes a theoretical and legal evaluation of it. This paper mainly expounds the regulations of the use and protection system in foreign laws, and studies the actual situation in Hainan. The second part is the analysis of the legal system of the utilization and protection of Hainan non-inhabitant islands. This paper analyzes the basic situation and legislation of the utilization and protection of Hainan's non-inhabitant islands, and analyzes the present situation of utilization and protection of Hainan's non-inhabitant islands according to the regulations of the foreign use and protection system. The main problems in the utilization and protection of non-inhabitant islands in Hainan are pointed out. The third part discusses the utilization and protection of Hainan non-inhabitant islands. The second part mainly discusses the problems in the utilization and protection of Hainan's uninhabited islands, and discusses the registration system, the acquisition of the right to use the non-inhabitant islands, the circulation, the perfection of the mortgage system, and the service life. The determination of the main body of Hainan's non-resident island management, the application of the prior environmental impact assessment system, the application of the sewage charge system, and the polluter pays system, To improve the special fund system for the protection of non-inhabitant islands and the construction of dispute resolution mechanism in the development and utilization of the non-inhabitant islands in Hainan, the corresponding countermeasures are put forward, mainly from the angle of the theory of economic law and combining with the actual situation in Hainan. To construct a comprehensive and effective system for the utilization and protection of Hainan non-inhabitant islands.
