【摘要】： 2005年,黨的十六屆五中全會通過了《中共中央關(guān)于制定國民經(jīng)濟和社會發(fā)展的第十一個五年規(guī)劃的建議》,規(guī)劃中提出了“生產(chǎn)發(fā)展、生活寬裕、鄉(xiāng)風文明、村容整潔、管理民主”的建設(shè)社會主義新農(nóng)村的總體目標。然而隨著經(jīng)濟的發(fā)展,我國在農(nóng)業(yè)生產(chǎn)過程中所產(chǎn)生的環(huán)境問題已嚴重影響新農(nóng)村建設(shè)目標的實現(xiàn),阻礙經(jīng)濟、社會、環(huán)境協(xié)調(diào)發(fā)展。筆者認為,要解決農(nóng)業(yè)生產(chǎn)環(huán)境問題,必須依法治農(nóng),加強農(nóng)業(yè)生產(chǎn)環(huán)境保護法律政策建設(shè),同時,在法律政策保障下發(fā)展循環(huán)農(nóng)業(yè)、生態(tài)農(nóng)業(yè),推進城鄉(xiāng)環(huán)境保護一體化,走農(nóng)業(yè)可持續(xù)發(fā)展道路。 本文中,作者運用環(huán)境社會學方法對河南省的三門峽地區(qū)進行實地調(diào)研,并對此地區(qū)在新農(nóng)村建設(shè)中出現(xiàn)的農(nóng)業(yè)生產(chǎn)環(huán)境問題以及原因進行分析,折射出我國農(nóng)業(yè)生產(chǎn)環(huán)境狀況,然后從我國農(nóng)業(yè)生產(chǎn)環(huán)境保護法律政策的現(xiàn)狀、實施效果和農(nóng)業(yè)生產(chǎn)環(huán)境保護法制建設(shè)的成就和缺陷入手,并與歐盟、日本農(nóng)業(yè)環(huán)境保護法律政策進行比較分析,最后從法學、法律經(jīng)濟學、社會學、生態(tài)學等方面提出完善我國農(nóng)業(yè)生產(chǎn)環(huán)境保護法律政策的建議,努力探索一條適合我國農(nóng)業(yè)發(fā)展實際情況的環(huán)保道路,期望對我國建設(shè)能源節(jié)約型、環(huán)境友好型農(nóng)業(yè)生產(chǎn)體系有所裨益,促進我國新農(nóng)村建設(shè)20字方針總體目標的實現(xiàn)。
[Abstract]:In 2005, the Fifth Plenary session of the 16th CPC Central Committee adopted the "recommendations of the CPC Central Committee on formulating the Eleventh Five-Year Plan for National Economic and Social Development," in which it was proposed that "production should be developed, life is well off, local customs are civilized, and villages are clean and tidy." Management democracy "the overall goal of building a new socialist countryside." However, with the development of economy, the environmental problems in the process of agricultural production in China have seriously affected the realization of the goal of new rural construction and hindered the coordinated development of economy, society and environment. The author believes that in order to solve the environmental problems of agricultural production, we must administer agriculture according to law, strengthen the construction of legal policies for environmental protection of agricultural production, and at the same time, develop circular agriculture, ecological agriculture, and promote the integration of urban and rural environmental protection under the guarantee of laws and policies. Take the path of sustainable agricultural development. In this paper, the author uses the method of environmental sociology to investigate the Sanmenxia area in Henan Province, and analyzes the environmental problems and causes of agricultural production in this area in the construction of new countryside. Reflecting the situation of agricultural production environment in our country, and then starting with the current situation of our country's agricultural production environmental protection laws and policies, the implementation effect and the achievements and defects of the legal construction of agricultural production environmental protection, and starting with the EU, The comparative analysis of the laws and policies of agricultural environmental protection in Japan is carried out. Finally, suggestions on perfecting the legal policies of environmental protection of agricultural production in China are put forward from the aspects of law, law and economics, sociology, ecology, etc. It is expected that it will benefit the construction of energy saving and environment-friendly agricultural production system and promote the realization of the overall goal of the 20-character policy of new rural construction in our country by exploring a path of environmental protection suitable for the actual situation of agricultural development in China.
