【摘要】： 隨著我國經(jīng)濟的快速發(fā)展,環(huán)境問題也日益突顯。西部作為我國經(jīng)濟文化相對落后的地區(qū),在西部大開發(fā)的進一步深入過程中,加大建設(shè)投資力度勢在必行。工程建設(shè)是促進西部經(jīng)濟發(fā)展的重要途徑之一,在給西部帶來經(jīng)濟效益的同時,也會對西部的生態(tài)環(huán)境帶來諸多不利的影響。我國目前對工程建設(shè)環(huán)境保護方面的法律法規(guī)比較零散且缺乏一定的體系,在西部地區(qū)更是顯得薄弱。因此,有必要對西部工程建設(shè)過程中涉及到的環(huán)境法律制度進行系統(tǒng)的研究,以達到西部經(jīng)濟建設(shè)與環(huán)境保護協(xié)調(diào)發(fā)展的目的。 本文以環(huán)境法學(xué)為理論基礎(chǔ),結(jié)合法理學(xué),工程管理學(xué)、建筑學(xué)等多門學(xué)科中的相關(guān)知識進行分析論證。以工程建設(shè)的整個流程中涉及的相關(guān)法律制度及其實施狀況為主線,來研究環(huán)境法制對西部工程建設(shè)的控制。并從中得出完善西部工程建設(shè)環(huán)境保護法律制度的建議,為進一步推進西部大開發(fā)和實現(xiàn)可持續(xù)發(fā)展提供參考。 全文共分為四大部分。 第一部分闡述了工程建設(shè)與西部環(huán)境保護的辯證關(guān)系。在肯定了西部發(fā)展離不開工程建設(shè)的同時,指出工程建設(shè)的大量興建會給西部的生態(tài)環(huán)境帶來不利影響。進而,分析論證了運用環(huán)境保護法律制度對西部工程建設(shè)進行過程控制的必要性。 第二部分著重分析了西部工程建設(shè)環(huán)境保護的理論基礎(chǔ)。首先是保護環(huán)境資源理論,其次是可持續(xù)發(fā)展的相關(guān)理論,最后是環(huán)境權(quán)的主要內(nèi)容,并說明西部工程建設(shè)環(huán)境保護是實現(xiàn)環(huán)境權(quán)的重要途徑。 第三部分是論文的主要部分。這部分介紹了環(huán)境法制對西部工程建設(shè)的過程控制。首先是工程建設(shè)前期的環(huán)境保護法律制度主要就是環(huán)境影響評價制度和“三同時”制度;其次是工程建設(shè)施工過程中的環(huán)境污染防治及建設(shè)中能源消耗法律制度;最后是竣工后的環(huán)境保護驗收制度、環(huán)境監(jiān)測制度和環(huán)境影響后評價制度。 第四部分針對上述問題,進行思考,并提出相應(yīng)的法律建議,包括西部工程建設(shè)環(huán)境保護立法和執(zhí)法方面的完善,以及環(huán)境影響評價制度、公眾參與制度和清潔生產(chǎn)在西部工程建設(shè)中的運用和完善。
[Abstract]:With the rapid development of China's economy, environmental problems are becoming increasingly prominent. The western region is relatively backward in economy and culture in our country. During the further development of the western region, it is imperative to increase construction investment. Engineering construction is one of the important ways to promote the economic development of the western region, which will bring economic benefits to the west, but also bring a lot of adverse effects on the ecological environment of the west. At present, the laws and regulations on environmental protection of engineering construction in China are scattered and lack of a certain system, which is even weaker in the western region. Therefore, it is necessary to carry on the systematic research on the environmental legal system involved in the process of western engineering construction, in order to achieve the purpose of harmonious development between economic construction and environmental protection in the western region. Based on the theory of environmental law, this paper analyzes and demonstrates the related knowledge of jurisprudence, engineering management, architecture and so on. Based on the related legal system and its implementation in the whole process of engineering construction, this paper studies the control of environmental legal system on western engineering construction. The suggestion of perfecting the legal system of environmental protection in the construction of western China provides a reference for the further development of the western region and the realization of sustainable development. The full text is divided into four parts. The first part expounds the dialectical relationship between engineering construction and western environmental protection. While affirming that the development of western China can not be separated from engineering construction, it is pointed out that the construction of large quantities of engineering construction will bring adverse effects to the ecological environment of the western region. Furthermore, the necessity of using environmental protection law system to control the process of western engineering construction is analyzed and demonstrated. The second part focuses on the theoretical basis of environmental protection of western engineering construction. The first is the theory of environmental resources protection, the second is the related theory of sustainable development, the last is the main content of environmental rights, and the environmental protection of western engineering is an important way to realize environmental rights. The third part is the main part of the thesis. This part introduces the process control of environmental legal system to western engineering construction. Firstly, the legal system of environmental protection in the early stage of engineering construction is mainly the environmental impact assessment system and the "three simultaneous" system, and the second is the legal system of environmental pollution prevention and energy consumption in the construction process. Finally, the environmental protection acceptance system, environmental monitoring system and environmental impact assessment system after completion. The fourth part thinks about the above problems, and puts forward corresponding legal suggestions, including the perfection of environmental protection legislation and law enforcement in western engineering construction, as well as the environmental impact assessment system.
