【摘要】：我國是世界上野生動物眾多、生物多樣性豐富的國家之一。現(xiàn)今，野生動物保護日益受到各國的普遍關注，我國也不例外。保護好這些野生動物對保護生物多樣性、改善生態(tài)環(huán)境、維持生態(tài)平衡、提高國家形象和聲譽，具有十分重要的意義。但是，由于科技的發(fā)展，人類對野生動物的不合理利用，使野生動物面臨著滅絕的危險。面對這種情況，人類需要采取強有力的措施來保護野生動物物種。而物種的保護卻是一個十分復雜的工程，它涉及到多個方面，需要運用多種手段進行調控，其中法律保護是野生動物保護最為重要、最為直接的手段。 從各國實踐經(jīng)驗來看，，具有國家強制力的法律對野生動物保護具有不可替代的作用，重視法律手段在野生動物保護方面的作用，已成為一種國際趨勢。許多發(fā)達國家為了保護野生動物已經(jīng)制定出一系列相當完備的法律、法規(guī)。新中國成立以后，我國的野生動物保護立法工作有了很大的進展并取得了巨大成效，但是隨著社會的發(fā)展也出現(xiàn)了一些問題，從野生動物保護現(xiàn)狀來看，保護形勢非常嚴峻，大量珍稀、瀕危野生動物瀕臨滅絕。我國現(xiàn)行法律在野生動物保護方面的局限性越來越明顯，需要完善野生動物保護法來加以解決。 本文首先探討了野生動物的概念、野生動物法律保護的必要性及意義；然后分析我國野生動物保護的現(xiàn)狀，闡述了野生動物保護面臨的問題；本文闡述了我國野生動物保護立法的現(xiàn)狀，在分析與借鑒外國及國際法相關制度的基礎上，提出了完善我國野生動物保護立法應當遵循的理念和原則，對我國野生動物保護立法存在的問題，提出了完善的建議。
[Abstract]:China is one of the countries with abundant wildlife and rich biodiversity in the world. Nowadays, wildlife protection has been paid more and more attention by many countries, and our country is no exception. It is of great significance to protect the biodiversity, improve the ecological environment, maintain the ecological balance and improve the image and reputation of the country. However, due to the development of science and technology, human unreasonable use of wild animals, wildlife face the danger of extinction. Faced with this situation, human beings need to take strong measures to protect wildlife species. The protection of species is a very complex project, which involves many aspects and needs to be regulated by various means, among which legal protection is the most important and direct means to protect wildlife. From the practical experience of various countries, the law with national coercive power has an irreplaceable role in wildlife protection, and it has become an international trend to attach importance to the role of legal means in wildlife protection. Many developed countries have enacted a series of fairly complete laws and regulations to protect wildlife. Since the founding of the people's Republic of China, great progress has been made in the legislation on wildlife protection in our country and great achievements have been made. However, with the development of the society, some problems have emerged. From the point of view of the current situation of wildlife protection, the situation of wildlife protection is very serious. A large number of rare and endangered wild animals are on the verge of extinction. The limitation of our country's current law in wildlife protection is more and more obvious, which needs to be solved by perfecting wildlife protection law. This paper first discusses the concept of wildlife, the necessity and significance of wildlife legal protection, then analyzes the current situation of wildlife protection in China, and expounds the problems faced by wildlife protection. In this paper, the current situation of wildlife protection legislation in China is described. On the basis of analyzing and drawing lessons from foreign countries and relevant systems of international law, the author puts forward the ideas and principles that should be followed to perfect the wildlife protection legislation in China. Some suggestions are put forward on the problems of wildlife protection legislation in China.
