【摘要】：近年來(lái),中國(guó)與東盟交往頻繁,雙邊貿(mào)易額逐步增長(zhǎng),經(jīng)貿(mào)合作關(guān)系不斷深化,合作領(lǐng)域持續(xù)擴(kuò)大。目前,中國(guó)—東盟自由貿(mào)易區(qū)已正式啟動(dòng),然而,隨著自由貿(mào)易區(qū)經(jīng)濟(jì)合作的深化,環(huán)境問(wèn)題也在擴(kuò)大。所謂的環(huán)境問(wèn)題是指由于人類活動(dòng)或自然原因使環(huán)境條件發(fā)生不利于人類的變化,以影響人類的生產(chǎn)、生活給人類帶來(lái)災(zāi)害的現(xiàn)象。為此,針對(duì)東盟國(guó)家的環(huán)境問(wèn)題,通過(guò)環(huán)境合作的手段,加強(qiáng)中國(guó)—東盟自由貿(mào)易區(qū)環(huán)境法律制度的構(gòu)建與研究,有利于我們正確的處理貿(mào)易與環(huán)境的關(guān)系,正確對(duì)待貿(mào)易過(guò)程中出現(xiàn)的環(huán)境問(wèn)題。 本文以中國(guó)—東盟自由貿(mào)易區(qū)的環(huán)境法律問(wèn)題為研究對(duì)象,從環(huán)境法的角度通過(guò)“提出問(wèn)題—分析問(wèn)題—解決問(wèn)題”的研究方法,為構(gòu)建中國(guó)—東盟自由貿(mào)易區(qū)環(huán)境法律制度,提出自己的觀點(diǎn)。 除前言與結(jié)語(yǔ)外,論文分為五章。本文的第一章是“提出問(wèn)題”部分,該部分內(nèi)容是自由貿(mào)易區(qū)與環(huán)境問(wèn)題。首先,對(duì)自由貿(mào)易區(qū)的含義以及中國(guó)—東盟自由貿(mào)易區(qū)界定及法律基礎(chǔ)進(jìn)行闡述。其次,提出了自由貿(mào)易區(qū)所面臨的環(huán)境問(wèn)題,并從經(jīng)濟(jì)學(xué)、法學(xué)的角度探討了貿(mào)易與環(huán)境摩擦及協(xié)調(diào)手段,第一章的內(nèi)容為提出論點(diǎn)提供背景與理論支撐。第二章屬于“分析問(wèn)題”部分,該部分的內(nèi)容是中國(guó)—東盟自由貿(mào)易區(qū)環(huán)境問(wèn)題分析,從環(huán)境問(wèn)題的表現(xiàn)入手闡述自由貿(mào)易區(qū)出現(xiàn)環(huán)境問(wèn)題的原因。第三、四、五章是解決問(wèn)題部分。第三章的內(nèi)容是解決環(huán)境摩擦的法律依據(jù),此處的法律依據(jù)包括成員國(guó)的環(huán)境法律、多邊環(huán)境協(xié)定以及貿(mào)易環(huán)境措施。最后得出的結(jié)論是：成員國(guó)國(guó)內(nèi)環(huán)境法以及與貿(mào)易有關(guān)的環(huán)境措施不足以解決自由貿(mào)易區(qū)面臨的環(huán)境問(wèn)題,中國(guó)—東盟自由貿(mào)易區(qū)需要一部專屬的環(huán)境法律。第四章北美自由貿(mào)易區(qū)與歐盟政策及啟示,以北美自由貿(mào)易區(qū)、歐盟自由貿(mào)易區(qū)的環(huán)境政策為對(duì)象,剖析了北美自由貿(mào)易區(qū)、歐盟自由貿(mào)易區(qū)環(huán)境政策的體系、特點(diǎn)并在制度領(lǐng)域、環(huán)境合作領(lǐng)域得出啟示。第五章構(gòu)建中國(guó)—東盟自由貿(mào)易區(qū)環(huán)境法律,是本文最后的落腳點(diǎn),強(qiáng)調(diào)環(huán)境合作的重要性,從構(gòu)建的基礎(chǔ)理論、構(gòu)建原則、模式、環(huán)境合作四個(gè)方面提出自己的設(shè)想與建議。 本文的主要論點(diǎn)是正確處理自由貿(mào)易區(qū)內(nèi)出現(xiàn)的環(huán)境問(wèn)題,單單依靠成員國(guó)的國(guó)內(nèi)法以及多邊的環(huán)境協(xié)定是不夠的,需要加強(qiáng)環(huán)境領(lǐng)域的合作,建立一部中國(guó)—東盟自由貿(mào)易區(qū)的環(huán)境法律,并圍繞如何建構(gòu)這一環(huán)境法律,提出了意見(jiàn)與建議。
[Abstract]:In recent years, China and ASEAN have had frequent exchanges, bilateral trade volume has gradually increased, economic and trade cooperation has been deepened, and areas of cooperation have continued to expand. At present, China-ASEAN Free Trade area has been officially launched, however, with the deepening of economic cooperation, environmental problems are also expanding. The so-called environmental problems refer to the phenomenon that the environmental conditions are unfavorable to human beings because of human activities or natural reasons, in order to affect the production of human beings and bring disasters to human beings. Therefore, aiming at the environmental problems of ASEAN countries, strengthening the construction and research of the environmental legal system of China-ASEAN Free Trade area through the means of environmental cooperation will help us correctly deal with the relationship between trade and environment. Correctly deal with the environmental problems arising in the course of trade. This paper takes the environmental law problem of China-ASEAN Free Trade area as the object of study, from the angle of environmental law, through the research method of "posing question-analyzing problem-solving problem", in order to construct the environment law system of China-ASEAN Free Trade area. Put forward one's point of view. In addition to the preface and conclusion, the paper is divided into five chapters. The first chapter of this paper is "ask questions", this part is free trade area and environmental problem. First, the meaning of free trade area and the definition and legal basis of china-ASEAN free trade area are expounded. Secondly, it puts forward the environmental problems that the free trade area faces, and probes into the trade and environment friction and coordination means from the angle of economics and law. The content of the first chapter provides the background and theoretical support for putting forward the argument. The second chapter belongs to the part of "Analysis problem", the content of this part is the analysis of the environment problem of China-ASEAN Free Trade area, starting with the performance of the environmental problem, the paper expounds the reason of the environmental problem in the Free Trade area. The third, fourth and fifth chapters are the problem solving part. The third chapter is the legal basis for solving environmental friction. The legal basis includes the environmental law of member countries, multilateral environmental agreements and trade and environmental measures. The conclusion is that domestic environmental law and trade-related environmental measures are not enough to solve the environmental problems faced by the Free Trade area, and China-ASEAN Free Trade area needs a special environmental law. The fourth chapter analyzes the North American Free Trade area (NAFTA) and the European Union (EU)'s environmental policy system, taking the NAFTA and EU's environmental policy as the objects, and analyzes the environmental policy system of NAFTA and EU FTAs. Characteristics and in the field of institutional, environmental cooperation to draw inspiration. The fifth chapter constructs the China-ASEAN free trade area environment law, is the final foothold of this article, emphasizes the importance of environmental cooperation, from the construction of the basic theory, construction principles, models, environmental cooperation four aspects of their own ideas and suggestions. The main argument of this paper is that it is not enough to correctly deal with the environmental problems in the free trade area by relying solely on the domestic laws of member States and multilateral environmental agreements, and that cooperation in the field of environment needs to be strengthened. This paper establishes an environmental law of China-ASEAN Free Trade area, and puts forward some opinions and suggestions on how to construct this environmental law.
