【摘要】：多種多樣的生物是全人類共有的寶貴財富，生物多樣性維護了自然界的生態(tài)平衡，為人類的生存提供了良好的環(huán)境條件，它是生態(tài)系統(tǒng)不可缺少的組成部分。然而隨著經(jīng)濟的發(fā)展，人們?yōu)榱诉_到經(jīng)濟目的不斷破壞生態(tài)環(huán)境，致使氣候變化反常，自然災害頻繁發(fā)生，生物種類迅速減少，稀有植物瀕臨滅絕。野生植物作為生物多樣性的重要組成部分,除了對維護生態(tài)平衡有著重要的作用外,還有著很大的經(jīng)濟、旅游、文化、科學研究價值。1984年以來,有關野生植物保護的國際條約、多邊協(xié)定、雙邊協(xié)定就形成了100多個。對野生植物的保護也是從那時起漸漸被關注的。1996年,國務院頒布的《野生植物保護條例》是一部以野生植物為保護對象的行政法規(guī)。 作為生物多樣性的野生植物資源是人類賴以生存，，社會發(fā)展的物質基礎。野生植物特有的生態(tài)價值在保障人類生存及生活環(huán)境中發(fā)揮著重要作用。在野生植物資源日益受到嚴重破壞的情況下,我國關于保護野生植物的法律體系還不是很完善。本文綜合運用了理論研究分析方法、比較研究方法和多學科交叉的方法等多種研究方法來探討野生植物保護法律體系的問題。 第一部分首先從生物多樣性保護的基本概念出發(fā)，論述生物多樣性的基本概念與生物多樣性保護的理論基礎。在論述了生物多樣性保護的基礎之上引入野生植物保護的基本概念,同時闡述了野生植物的概念以及野生植物保護的產(chǎn)生與發(fā)展。第二部分介紹了我國野生植物法律保護的現(xiàn)狀，并指出了存在的問題。第三部分開始介紹國外生物多樣性保護法律制度的現(xiàn)狀，如美國、英國、澳大利亞的野生植物保護概況，進而分析出國外相關立法可借鑒的經(jīng)驗。第四部分結合我國具體國情，提出了完善我國野生植物法律保護的對策，包括野生植物保護立法體系的完善、重視野生植物的生態(tài)價值、擴大野生植物資源保護的范圍、完善野生植物保護的法律責任和提高公民保護野生植物資源的環(huán)保意識等，從而達到保護野生植物的目的。
[Abstract]:Biodiversity maintains the ecological balance of nature and provides good environmental conditions for the survival of human beings. It is an indispensable part of the ecosystem. However, with the development of economy, people continue to destroy the ecological environment in order to achieve economic goals, resulting in abnormal climate change, frequent natural disasters, the rapid reduction of biological species, rare plants are on the verge of extinction. As an important part of biodiversity, wild plants play an important role in maintaining ecological balance, and also have great economic, tourism, cultural and scientific research value. Multilateral agreements, bilateral agreements on the formation of more than 100. Since then, the protection of wild plants has been paid more and more attention. In 1996, the State Council promulgated the "regulations on the Protection of Wild plants", which is an administrative law that takes wild plants as the object of protection. As a biological diversity, wild plant resources are the material basis of human survival and social development. The unique ecological value of wild plants plays an important role in protecting human survival and living environment. With the serious destruction of wild plant resources, the legal system of protecting wild plants in China is not perfect. In this paper, several research methods, such as theoretical research and analysis methods, comparative research methods and interdisciplinary methods, are used to discuss the legal system of wild plant protection. The first part discusses the basic concept of biodiversity and the theoretical basis of biodiversity conservation from the point of view of the basic concept of biodiversity conservation. Based on the discussion of biodiversity conservation, this paper introduces the basic concept of wild plant protection, and expounds the concept of wild plant and the emergence and development of wild plant protection. The second part introduces the current situation of the legal protection of wild plants in China, and points out the existing problems. The third part begins to introduce the current situation of the foreign legal system of biodiversity conservation, such as the United States, Britain, Australia, wild plant protection overview, and then analyze the relevant foreign legislation can learn from the experience. The fourth part puts forward the countermeasures to improve the legal protection of wild plants in China, including the improvement of the legislative system of the protection of wild plants, the importance of the ecological value of wild plants, and the expansion of the scope of protection of wild plant resources. Improve the legal responsibility of wild plant protection and enhance the citizen's awareness of environmental protection of wild plant resources, so as to achieve the purpose of protecting wild plants.
